    Great to hear your wife's approval and hope she is doing fine now, after the emergency.
    Appreciate your helpful attitude towards others who are struggling with USCIS process.
    After the infopass for me and my wife, we had multiple soft/hard luds and status changed to case moved to local office.
    Received mail that we would be called for interview.
    Wish they get this fast when the dates are current.

    Good to see that there is some activity going on our cases..i got the response form USCIS saying that "the case is pending at the USCIS office" dose this means they transfered the case to local office? or still at NBC..dose your message says that the your case has been transfered to "local USCIS office" or just "USCIS office"?..

    I am a highly-skilled professional who entered this country legally. I've
    been waiting for my US permanent resident visa -also known as "Green Card"
    for the past several years along with 500,000 other educated, highly
    skilled employment based (EB) immigrants. Many of us have been waiting for
    our turn to get Green Cards for 5-10 years while consistently abiding by
    all the laws of this country. Such long delays are due to tortuous and
    confusing paper work, backlogs due to various quotas and processing delays
    at US Citizenship and Immigration Service (USCIS), other allied state and
    federal agencies.

    Several categories of EB immigrant visa (Green Card) numbers were
    unavailable ("retrogressed") since the fall of 2005. For the past several
    decades, the US Department of State (DOS) has been publishing advisories
    known as visa bulletins once a month to announce the availability of
    immigrant visa numbers. On June 13, 2007, after a gap of nearly two years,
    DOS announced that all EB visa numbers would be "current" for the month of
    July. This meant, irrespective of our "priority date" (date assigned to us
    for our turn in the line for Green Cards), all of us were made eligible to
    apply for some interim immigration benefits. This "priority date" refers
    to the date when our labor certification (documentation verifying no US
    citizen worker was available for a given job) had been filed.

    Please note that 6/13 DOS announcement would not have led to immediate
    green card for most of us; but at least it would have ensured us interim
    benefits such as the right to travel and right to work for any employer-
    this was still a welcome change. Especially, for dependent spouses who are
    otherwise unable to work, this would have translated into right to travel
    and work without restriction and thus channel their energies positively.
    Several dependent spouses are also highly-skilled.

    Tens of thousands of applicants spent thousands of dollars in legal fees,
    immigration medical exams & vaccinations & getting various supporting
    documents ready to file our immigrant petitions to USCIS, at times
    inconveniencing our old parents in our home countries as well. It has been
    an agonizing two weeks for us. Some of us to had to fly in our spouses
    from our home countries or have had to cut short business trips. Hundreds
    of millions of dollars were spent by thousands of immigrants in
    preparation of their application. To our shock and dismay, on the morning
    of July 2nd 2007, USCIS announced that EB visa numbers were not available
    and all petitions filed in July would be rejected.

    For the legal skilled immigrants this has been a rather traumatizing and
    disheartening experience. These are people that are in the country
    legally, paid taxes and followed all the rules.

    We sincerely seek immediate congressional/ legislative remedial measures
    which would (1)Reduce the enormous backlogs of green card petitions of
    legal skilled immigrants (2)Ensure and request USCIS not to reject our
    immigrant visa petitions filed in July and provide us interim benefits of
    a pending immigrant visa petition. We make this sincere request with the
    hope that people who played by the rules will be rewarded.

    That's exactly what I wrote a few posts above. I think the more basic question is - What does 485 inventory mean? Is it already filed 485 numbers or "can be filed based on approved I-140" numbers?

    To the OP: Can you provide the link from where we can open the PDF instead of just throwing the PDF open. Maybe that will provide a better context to the numbers.

    If these are pending 485 applications at USCIS, Number of pending applications with PD later than JUL 2007 should be zero.

    If these are labor filings, they probably dont include dependents.

    My attorney originally applied for my labor (regular process) in late spring 2006 but due to another issue we decided to expedite (premium process) in early winter 2006. Question is, is early spring my PD or early winter of 2066? (Sorry don't have the exact dates in front of me).

    Congrats!! good to know. If we can see the trend, I will be very happy man atleast got some attension for forgotten July 2nd souls... :)

    Good news guys, my checks have been encashed this morning, looks like they are processing july 2nd cases now, probably because of all the pressure from congressmen and all the complaints that have been going out to uscis-complaints.

    Finally some relief, the receipt #'s are printed at back of the check and its starts with SRC so i guess it has been transferred to either CA or TX.

    Hang in there guys iam sure all july 2nd filers will surely see their applications processed by early next week.

    I am so emotional now........just got the email, text message and message on the website changed to "Decision"

    Mine, my wife's and my son's cases APPROVED!!!!

    My case was in NSC. No additional fingerprinting, except one in Oct 2007, my son had to do one since he turned 14 this year....

    14 years of wait is over......Praise be to God for his faithfulness and mercies

    Another answer from Rajiv Khanna: on multiple 485s
    I recommend both husband wife file for yourselves and for each other. So between the two , there will be four 485 applications. One: Wife as primary, husband as derivative. Second, husband as primary and wife as derivative. We do this all the time and this is the safest thing to do. You will keep whichever 485 set gets approved, first, the other will be rejected by CIS.

    I still need a link to the testimony of USCIS director confirming wastage of green cards. I would greatly appreciate if someone compiles list of e-mail addresses of judiciary committee members. Please note I would be making calls myself. E-mail is only for colleauges as I can't ask for their time on telephone calls. Here is my dreaft: -

    Dear Member of Congress:
    Congress has an opportunity before it adjourns to help advance U.S. innovation leadership by
    enacting H.R. 5882, a modest, bipartisan bill that would simply �recapture� employment-based
    immigrant visas numbers that Congress authorized in prior fiscal years, but that went unused due
    to government processing delays. H.R. 5882 is a common sense measure that should be enacted
    without delay this year.
    H.R. 5882, which Representative Zoe Lofgren introduced with Representative Jim
    Sensenbrenner, would help reduce visa backlogs by recapturing Congressionally authorized EB green cards from prior fiscal years that went unused due to bureaucratic delays.

    What is H.R. 5882?
    By recapturing unused green cards H.R. 5882 would address the issues of justice, equality, fairness and efficiency; at least temporarily.
    H.R. 5882 addresses a very important issue of discrimination of high skilled immigrants in the US immigration system on the basis of their country of birth. As per the current law the quota of employment based green card is equally distributed to applicants on the basis of their country of birth. No single country can take more than 7% of the annual quota of 140,000 green cards. Thus the applicants born in two countries India and China, who contribute more than 50% of the high skilled immigrants, have to wait lot longer than applicants born in other country. Simply put an applicant born in XYZ country gets green card in six months and applicants born in India or China with exact same skill sets & exact same contribution to US economy has to wait for years and years indefinitely for his/her green card.
    In addition to this, due to bureaucratic delays, a lot of green cards go unused from the annual quota of 140,000 every year resulting in processing backlog stretching up to decades.

    What H.R. 5882 is not?
    H.R. 5882 is not an amnesty. It does not legalize any illegal immigrant. It does not provide any waiver to any unlawful stay or unlawful activity in the US.
    It does not increase congressionally authorized immigration limits. It does not authorize even one extra green card than what is authorized by congress.
    It does not take jobs away from US, rather helps keep the job in US.

    It is very important to note that the overflow of visa numbers in the family based immigration system is transferred to employment based system but NEVER vice versa.

    All the high skilled immigrants who are in green card limbo are in this country for many years now and contributing to economy, paying taxes. They have steady jobs and during the three stages process of green card it has been established multiple times that a US citizen or permanent resident is not available for that job. Close to million applicants are limbo due to bureaucratic delays and country based quota system. If they get green cards they are in position to buy new house, car, start new business etc. there by making significant contribution to economy.

    I request you to support the passage of the bill through US congress.

    Hello, I can understand your pain as I was in a similar situation as you are. I would recommend to wait for atleast 2 weeks. I interviewed on 28th Dec and finally got the email on 9th Jan and the pp stamped on 10th Jan and took the flight on 12th Jan.

    If you have an upcoming travel which is in next week, please try to reschedule it as it is not certain on how much time does it take in such cases.

    I do not think getting the employer involved into this will help. VFS office will have no clue on this and they will answer only Questions on the process. Writing to the US consulate will also give you a general answer. It is sad that there is no accountability in cases like these. Please keep the faith.


    I am in the same situation. Appeared for interview on 8th jan in Mumbai. They returned my PP, I-797 with a yellow paper and asked me to wait for email. Haven't recieved any email yet. Do I need to contact my employer? Does my employer need to call someone in US for approval? Or shall I just keep waiting? It is very frustrating. I called VFS office but they don't know anything.. If anyone has received email or approval please keep us posted as this is the only source of information.

    I am saying Recapture will only help EB2 and not EB3. Bcoz all the recaptured numbers will be used by EB2 first. So EB2 dates will move forward and then people with PD in 2007 and 2008 in EB2 will use up captured numbers and EB3 will still be waiting to get any leftovers.


    I am not saying you are wrong but we need numbers to say one way or another. Like I said, the pending EB2-I using the most generous distribution is half of the recapture numbers. There is fresh inflow from new H1B and such but it seems unreal to me that EB2 will not become current with the recapture.

    I also agree that it would be better if the recapture numbers are divided, equally or in some manner, among the categories.

    Right now, it seems that even if USCIS gives EB1+EB2 ROW numbers to EB3 ROW, the unused EB3 ROW numbers would go back to EB1-C/I--> EB2 -C/I --> EB3 C/I.

    Again, I am not here to suggest you shouldn't take the initiative in doing what you think is best for you.

    ...how is USCIS involved in this other than adjudicating cases and providing statistics to DoS as far the EB3 allocation issue is concerned?

    Why are you guys taking about USCIS's interpretation of the law ??? What have they to do with it ? :eek:

    I think this is an opening and the outcome will depend on how we respond to it.

    We are in the middle of a fight to get recognised of our problems and for sure the director responded to our non-violent protest.

    What we do next will count.

    Should we lay down our arms a surrender now? This will be a sign of weakness. Lets fight on.


    Why is everybody so happy? He has just briefly and curtly informed in the message that flowers will be forwarded. They won't be sitting on my desk and embarrasing me. There is no acknowledgement of the issue or any empathy or compassion with the sufferers. Now even the press coverage will make USCIS director look good. I don't see what's the positive development here.

    Yes this is true. last year i my wife's EAD was dealyed after 90 days so i walked into a USCICS centre and they said they no more issue INTERIM EAD's.
