    I always travel by Asia route. China, Japan, Thailand, Singapore or Korea. For people on the pacific route this is the best option. The customer service is pretty good and they do not harass you for every petty things.

    Fying from UK and France in particular feels like you are doing a favor to them. In this age of consumerism just stay away from British, Virgin, Air France and others and they will learn the lesson quickly. Iam very surprised why people take those routes. Just avoid them at all costs!

    While filing for I 485, I was wondering if I can file for my wife's EAD and AP and dont apply for mine (at this time) as I am not going to change the job in next few months. So I will keep working on my H1 (valid till 2009) and she can work on her EAD? Is it possible and legal to do ?

    If USCIS wants to do bad regulations, they will do it - with or without IV campaign for reform. What is the gaurantee that Michael Aytes will not issue a memo tommorrow restricting job movements further? They always keep doing that every now and then, on their own.

    Given the current volume of changes 350,000 apps, regulations are bound to change, one way or another. Whether you want it or not. If USCIS officers (not the top brass) feel overburdened with EAD/AP work they'll start issuing more, and more, random RFEs, NOIDs etc. to reduce their burden ( passing the burden to you). They also might introduce labor market and other restrictions to reduce the backlog by eliminating all AC21 users. What is stopping them from doing it on their own?

    Evading activity under the pretext of imaginary fears will not stop USCIS tommorrow if they decide to pass tough regulations. By requesting the 'right' changes, we are making sure 'wrong' changes don't happen. For that to happen we need to get involved in the decision-making process and influence the decisions in the right direction.

    Agreed. Positive intervention is always better.

    I read one post on one of the IV thread. According to that 740,969 Applications are including Family based application. according to that post there are about 400,000 Employment based AOS applications pending.

    I think if number of employees are less than 50 then 50% rule will not be applicable(according to 2007 proposed bill). It may be similar to that.

    But are n't they proposing 50 % rule.. how can a small desi company afford 50 % US citizen staff ? That is why may be people think consulting companies will not work.

    but what I think is it will make them less profitable. Very small body shoppers will go out of business. Med to large indian owner based consulting companies will be less profitable.

    Green card seekers take to 'Gandhigiri' in US

    Washington: In an eloquent display of Gandhigiri, unhappy Indian green card seekers sent hundreds of flowers to the US immigration agency to protest a last minute reversal in policy that would impede their way to permanent residency.

    Inspired by the hit Hindi movie Lage Raho Munnabhai that extolled Gandhian ways of non-violent protest, the green card applicants plan to send around a thousand flower deliveries to US Citizenship and Immigration Services (USCIS) Director Emilio Gonzalez in a three-day campaign that started on Tuesday.

    The protest followed the abrupt reversal last week of a June announcement offering expedited processing of green card petitions for thousands of skilled foreign professionals working under H1-B visas - reserved for skilled workers in computing, engineering and other special professions.

    Thousands of such visa holders scrambled and spent money on lawyers and medical exams to beat the July 1 deadline for green card applications. The abrupt change sent them back to the queue for 2008.



    Besides India, skilled workers from China, Poland and many other countries will now have to spend more time and money to get the coveted green cards - a halfway house to US citizenship.

    "The idea is to push them to honour their earlier notification," said Aman Kapoor, founder of Immigration Voice, a forum that inspired the unusual protest.

    Indians are the worst hit by country quota caps for immigration visas, which treat a billion strong India, boasting a highly skilled workforce, on par with a country like Trinidad and Tobago of one million souls, he said.

    On its part, the USCIS response was equally pacific. It plans to forward the flowers to Walter Reed Army Medical Centre and Bethesda Naval Hospital in Washington, the main facilities treating US soldiers wounded in Iraq and Afghanistan, said Gonzales in a statement on the agency website.

    that the offer was taken back based on EAD status.
    anyway, I understand the lawyers need to be paid! I just want them to stop changing the rules in the middle of the game. Its been a long frigging wait and now this.

    My hope is that there was some misunderstanding and that they will just quietly remake the offer and give me the job back.

    At will employment does not mean you can discriminate. Its akin to firing someone if they get pregnant or me leaving because I did not like the skin color of my boss. Both are discriminatory if they can be proven. In this case it can be.

    I received the card production ordered email today morning, after 1 hr again I received a Decision email. Online status shows as "Decision" , does this mean my 485 is approved?

    How many times in this thread I have mentioned that I am getting replaced by one of these L-1B resource, I am a poor Oracle/DB developer who fortunately cannot be replaced by L-1B visa resources (as my skills is a common technical one). So once these violations impact your day to day life you look around for ways to stop this fraud. Its true that if I was a Nuero Surgeon in Phily or a Astro Scientist in Houston I wouldn't be interested in this violation :-) .... tomorrow let this scenario happen to you ... you would be first one to raise the alert.

    Regarding 'getting burnt', I don't think there is bigger burn than loosing our jobs (which already is happening) and hope you know that there is something called 'anonymity'... ya lets see whos going to get 'burnt' here. We'll definetly keep you updated regarding the outcome.

    I sympathize with you. If your job is getting impacted by this, you have every right to complain.

    On a friendly note, you need to upgrade your skill. You cannot survive on just oracle/db development.

    If your PD is 2003, then you are waiting for 5 years, not for decade. Just FYI, saying decade (instead of 5 years) is material misrepresentation.

    Quick question.

    IV has asked for 2 copies, one to the President and one to IV. Couple of questions on that.

    1) Does the letter addressed to the President need to be in a seperate stamped envelope?
    2) What is the reason behind 2 copies?

    eb3_Nepa, definitely the letter to the President has to be in a separate stamped envelope and hand written is preferable.

    Reason behind 2 copies is that IV also want to collect the copies of all the letters sent out to the President. So that when we talk to the administration, we can show them how many folks are being affected because of this GC retrogressions.

    I hope i have answered your questions.

    Hi guys,

    Sorry, I bit the bait and got off track. Let us focus on the issue again. Let us agree on a time line and act accordingly.

    I would say, this week we work on drafting the letter (I took a shot at it, available @ page 2). Having 2 or 3 differently worded letter would probably be nice, but not necessarily.

    Next week we start mailing the letters. We have about 500 responses in the poll for EB3, so if we can get most of them to send the mail (email/fax whatever), it should be a start.

    We probably should start drafting a mail for our representatives/senators too, so that they too can follow up with USCIS.

    We will face a lot of opposition, ridicule and nasty posts, but we should persevere if we want to get our GCs any time soon.


    I agree we should focus on the task. There are lot of people trying to mislead and take the discussion off track. I will draft my own letter and send it this weekend. Its better if everyone writes there own letter. EB3 guys wake up and do something.

    Hi Shweta:

    First, don't panic :) I doubt there's anything we can do about it at this stage. I'm in exactly the same situation (interview at the Delhi consulate on the 22nd, response - administrative processing, and the consular officer had told me that I'd get it in a week).

    According to my lawyer, our cases have been sent to Washington for security clearence. And based on the feedback she has been getting, it is taking about a month. The embassy cannot issue our visas till they hear back from Washington.

    So I realize that it totally _SUX_ but there's nothing we can do about it. So just chill and wait..

    in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!

    NOT SURE WHY ?? this delay is ??

    i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?
