    I concur with the opinion of getting into IIT's is not a bench mark for success. It depends on what a person considers success. As far as "Best among best" is concerned, I used it only to compare the number of seats available for equally intelligent students in India and US. A student in India with similar aptitude, IQ and what ever comparable metrics has lesser chances of accomplishing what a student accomplishes in the US. let it be getting into IIT's or Ivy leagues.

    I am suprprised if IV is working towards abiltiy to file 485 and hard country limit...Just want to know how IV is working towards these 2 items...
    If any of these two wont show out in coming bill,..then I would say goodbye to IV..because all other items in bill were there without IV;s interaction....

    Can somebody calrify if these options will anyway include in this bill..by means of ammendements...

    We have been fighting very hard to introduce a number of amendments including the ability to file I-485 and also to remove the country limit. We have spoken to a number of senators in this regard.

    While we have no guarantees that they will be introduced, one thing I can guarantee, we will fight as hard as we possibly could.

    I agree that we MUST educate them.

    Most of them do not know anything about L1. They think only about H1. I have been to my Congressman's office several times and have written numerous letters (not emails but printed and signed letters, as they have a better impact).

    Requst one and all to do that. CIR is dead now. What next? can we debate?

    I don't know what's the logic behind the processing dates. How could all the dates move back so much? It does not make any sense. I wonder if we could contact someone regarding this or maybe, USCIS wants to minimize the number of queries and moved the dates back so fewer people call and ask for status?? I have no idea what's behind it.....

    gcbikari, the link that you have provided is great, I just looked up a company and saw that the company owner got arrested last week, whom I would have joined. Man, he was doing a sugar coated talk when I was looking for job, and through out his speech he was talking only in millions, like we bought this company ABC last month for 20 million, and in walks in the owner of ABC Company with ragged clothes, really! man who has 20 million.

    Seems like MOtor Vechile dept is fianlly caught up with the Retrogression. I have been driving with Temp DL past 5 months. I was thinking it was the random check but this thread makes sense to me now

    that such approvals would be due to visa number allocated to a persons case when the visa dates were current. or allocated to prevent visas from being unused in the FY 2007. It may be an unlikely that such approvals (without PD being current) will continue in the 1st 3 quarters of FY 2008. Also it would be very safe to issue EB GC visas to ROW applicants as most likely they wont hit per country limit.

    The AC21 law was enacted to help you from exactly the same situation and you have absolutely nothing to worry about.

    But as well know how USCIS works, the BAD case scenario would be that you'll get an RFE after your I-140 is revoked and at that time, you'll need to provide some proof of your employment in the same or similar field along with a copy of the AC21 text.

    The WORST case scenario would be that you'll get a NOID from an ignorant officer, and in that case as well, you'll have to reply with same documents and you'll get approved.

    Mark my words : Your I-485 will get approved ultimately(unless you have comitted some kind of fraud )


    About the employer, I think he's right that any I-140 which has a pending I-485 associated with it , is counted towards the ability to pay and it affects the future I-140s from the same employer.

    I have EAD approved and 485 pending over 180 days. But 140 is still in process. My company decided to lay me off. What options do I have ?

    1. The company is not mean to revoke my 140 unless it is required by law to revoke 140 for all lay offs, Please advise.
    2. What options do i have now to retain my GC process

    You have a little tricky situation at hand, but you'll be okay if what you wrote is true - Your employer will not revoke your pending I-140. Not only that, they have to be nice enough to respond to any RFEs that come for your case. they can state that the imimgration application they filed for you is for a future position.

    Also, USCIS has a guideline about these cases. They are supposed to see if your I-140 was 'approvable' if it had been adjudicated within 180 days or before you leave the company, which I think it should be.

    I understand there are some anxious days ahead for you, but If I had to bet, I would bet on successful result of your case in the end :).

    Just make sure that your old employer doesn't revoke your I-140

    BTW, when was your I-140 filed?

    yes, this whole debate is useless anyway, since there's no meaning to those dates, maybe just for extreme cases, that are delayed even beyond the usual unreasonable delay.
    If you manage to get your employer to get a SR open for you on the I140, chances are, you'll get your I140 approved before you'll get any response to the SR, since USCIS takes that ridiculous 45 business days to respond.

    There is no doubt that IV has done a lot in the past and IV has great potential.
    but why does everything come down to funding and lobbying ..can't we do anything without money ??
    as I mentioned above IV has done a lot in the past but it is very very quiet now !!
    say lobbying costs a million dollars ...it will take 100 years to raise that much money
    how much money does it cost to come up with a new campaign or to announce a new campaign ???
    I know my post will attract red dots etc ..but I am close to the point where it is either do something or wait for it to happen
    You can run a campaign to contact media about this concept and get articles and interviews published. This would not cost money and would only require volunteer effort. You can start from your local paper and then try to increase it to other papers nationally.

    Please lead such an effort and get other like minded members with you. That may help get publicity for the idea. You can also write some op-eds and get them published on this issue.
