Your point is very much valid, But ok lets for a min assume H1b is eliminated completely. Do you think these big IT firms or even small consulting firms stop doing their business ? No. if not H1B there will be other way bringing ppl for short term. they will be some other way to do it. H1B is not designed keeping us in mind its designed keeping US Citizen employers in mind. and also it is adding to USCIS revenues. if you see even in current fiscal year i have seen all of my friends who did premium got thier H1b approvals.
The reason i said H1B outsourcing will start is most H1's are held by Big IT firms of India. If they do some thing that will hurt it they will do something else or reduce onsite avail or make it short term there will be some other workaround but no way these jobs will go back to americans.
Key point we have to argue and keep on doing it is the fact that , drawing a comparison between us and illegals. Even illegals have marched on streets and expressed their concern of not leaving USA if so why we paying millions of taxes adding source to housing market and GC in a valid stage , should ever even think of losing it ?

Yes, GC is not life, we might back to our country still with good quality life. But deported by this piss-off reason, We really can't be ease.
Just meet some prideful but stupid local American, can't depend on their intelligence. Just like my wife tried to explain we don't speak English at home to refute that ridiculous "help" shouting, but the leasing office ass manager question, "Why you speak English with me now??? " How can I comment? "Can you understand if I said my native language?" Finally we have to find a new apartment in 3 days.

I think you need a second opinion from a lawyer, no one here can really help you (unless he/she is a lawyer).
If your version of the story is really the absolute truth (assuming there is no wrong doing on your part) then you should fight, the system is fair (I'm sure people understand language barriers) and I'm sure judgment will be in your favor.
Just a word of caution... Don't underestimate the intelligence of people making the judgment, they deal with such cases everyday - they can easily smell a rat.
GC is not life, the trial verdict can change your life for better or for worse (specially if there is jail time involved).

3) Parents home need urgent repair (bona fide business reason)

still something is wrong. USA does not descriminate based on country of birth, in this case there is a punishment for being born in india.
I know, it is unfair and frustrating. But from legal point of view, you are mixing Employment Laws with Immigration Laws.

I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
That company is MSU software based in Iowa ( just in case if anyone knows about it ) .
I tried several times approaching USCIS as well as Congressman's office to find the details of delay / extended review status etc but all I got was we need to wait until the review is complete.
I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .
I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .
I have sent the email to info@immigrationvoice.com just now.

AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

Your case is eligible the chances are high that you'll get it, if dates remain current. And as folks have mentioned, 180 days rule applies. Your infopass will tell you clearly what's happening to your NC but that is immaterial.

So I withdrew my original post to remind you of the 180 day rule which says where the application is otherwise approvable and the FBI name check request has been pending for more than 180 days, the adjudicator shall approve the I-485 and proceed with card issuance.

According to my lawyer, the person (in this case your wife) must be in USA until your wife's AP application is accepted. Basically your wife should not try to apply AP when the she is not physically in USA.
After the application acceptance, your wife can travel.
Disclaimer: Please do not take this granted and always consult your immigration attorney.
I would like to differ on this, the person applying for a renewal of AP does not have to be physically present in the US until the AP is approved. Our attorney confirmed this and if you notice on the AP application form it states if the document has to be mailed to a different address other than USA.
Our attorney said one can apply for a renewal even from a different country, the clause that one has to be physically present in US is only for the initial I485 and AP application.
I have applied for AP renewal on June 23rd and am traveling next month to India for 2 months will be back before my current AP expires i.e. Oct 10th. My attorney actually asked me to apply for renewal before I leave for India.

I just call them, was told that they have no additional information that what is available on the recorded message or the USCIS case status web site. I said I wanted to know if the case is 'pre-adjudicated' and the lady mentioned that that information is not disclosed. ;(

Going back might be a good call. But the truth is, no matter how much money you got, how secured you are, the bottom-line is that the call has to come from the individual.
I will share my concern. I was 23 when I moved here and I already spent 10 years of prime life here in this country. After finishing my college, I worked in India for a year and half, and as any young adult I grew up thinking one day, I will change the way life operates in India. There is a system which operates India. It is powerful, normal human like you and I cannot overcome the system. People like Gandhi could, they are willing to sacrifice them self for the best of others. Or you could people like our current politicians who know how to work the system. People like lallu, Jaya, Karunanidhi, Naidu etc, they grew up as a part of the system. For them even when killing someone, they might not feel the remorse. But you and I cannot even bribe without feeling bad, which is good. But the question is how long can you sustain that? I am not 23 anymore; Now, I know what responsibility is all about. I have 2 kids; I don�t know whether I am hard enough to fight the system at this current stage of my life.
There is a famous quote, which states that there is a breaking point for every human, once we are pushed beyond that point, your action does not originate from your brain. In other words you will become part of the system.
For me this is the main concern. When I talk to people here who wants to go back, they say that they will buy a house in some close community and they will live a happy life inside. For me that�s a fools dream. You cannot shut off from others, may be for a month or two, soon you have to face the real world.
So the answer for your question like in this question. How are you going to handle the system in India? I do not believe that things will change. May be in 25 years; Not anytime soon. So until then you have to live a life where in you have to adjust to the system.
I do not have an answer to the question. How will I manage the day to day life? If you know the answer let me know

I think I know you, sorry I am kidding :), cuz pretty much everyone's story is very similar to yours, I tend to agree with you, but itz not that bad, infact I would itz a good gamble if you return now you will be going to emerging market and you might endup making most of it, About bribe and corruption if you study the history it was created out of bad politics and system as things are changing with better system it will be reversed, you will never have political system with out corruption atleast there none exist on face of the earth, I am positive about India and itz growth,
Main issue for me is CHANGE, when I came I was just alone young with lots of hope, now I am an old man with family, however I brought a house back in India and couple of sites which are giving me good returns, so I do have plan B

AND ONE MORE THING. THESE PROCESSING DATES ARE FOR RENEWAL APPLICATIONS. NOT FOR NEW APPLICATIONS. FROM MY EXPERIENCE I SAW FIRST TIME FILERS ARE GETTING THEM IMMEDIATELY THAN RENEWALS WHICH WERE TAKING 2-3 MONTHS.
It does not anywhere say that this timings are for renewal. I have my 3rd EAD now. Everytime, I got my EAD approved based on processing times given in the web site. I found one difference, when I filed my 1st and 2nd EADs at California, I got them in 1 month(but again based on processing times). Now the 3rd one, I got in 3 months(again based on processing times)

The following are various ways to express some one�s dissatisfaction/agony and draw some one else (Government/Media/Public) attention.
10. Sweeping Roads : A group of people would sweep roads by wearing immigration slogans jackets.
11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).
We still have various other ways to express our dissatisfaction, however, they are little rude and could cause more issues.
We should choose couple of ways from above to express our dissatisfaction. Members, feel free to add and delete from above list.
P.S: We need prior permission from local authorities

11. Organize Blood Donate Drives : Interested member would donate blood (We should explain to media, why we are doing so).
We still have various other ways to express our dissatisfaction, however, they are little rude and could cause more issues.
We should choose couple of ways from above to express our dissatisfaction. Members, feel free to add and delete from above list.
P.S: We need prior permission from local authorities

Good point , Yes we need to give our response to it. but neither H1B says its only for INNOVATORS rather it says only SKILLED workers. Not even every PhD is innovator . May be in some circumstances the so said perspective is true but i dont agree with every point.
I work in a comp where mostly they have GC or Citz and in some cases they waited even 2 months + and then decided to take H1b's.
There are no enough Americans who can do the Job if these guys think its H1B and remove H1B every Job will land as an outsourcing . If not h1B many Outsourcing IT firms will find some way to temp bring IT pros and eventually outsource.
The Key point that IV is making is how much taxes we are paying and how good we are making to American economy. If they remove H1B ,then they understand how and what they have lost.

i am not sure if any one of you has tried donating blood in the US, i have, and have been refused a couple of time for reasons ranging from
you have been to india too recently, need 12 months of continued presence in the US
