    I have two I-485 pending. Both filed by me.

    One is based on National Interest Waiver for physician I-140 (self petition). The second one based on PERM I-140.

    Both I-140 are approved. Both I-485 pending one since 11/04 and second 7/07. Fingerprints done for both and medicals done for both.

    First I-485 needs total 5 yrs of service in physician shortage area (which will be completed in about 6 weeks)

    Does anybody have similar situation. What to expect now. I have PD of 9/04 on both the cases. Dates will become current from August 1st.

    USCIS is not prepared for anything. if this works then great. if not i tried didn't work out.... :)

    I fully agree that USCIS should work FIFO, but "should" does not make that happen. Clearly USCIS is not equipped for FIFI when truck loads of applications arrive. We may complain now, but I believe we should give them additional 10 days they need (to make it 90 days). I am equally worried about my July 2 filing. Nevertheless, I wish and hope the congressman's intervention helps.

    All,

    Its good to see some of the Very active members of s-1932 again in this site.
    This site looks very good, I followed the S1932 thread in immigration.com very closely, but was disappointed after its defeat inspite all the guys aggressive enthu and hardwork. As most people i too feel that we failed because of lack of Lobbying. If everyone can contribute for noble cause that will be great. I have a small suggestion I am not sure whether it sounds right to everyone or not, but in order to start collecting the funds i would suggest that Moderator open a new thread/link about the contributions so that members who are joining eveyday in this forum will get the momentum to contribute. It would be good if it has name(Registered name), amount and date and the sum collected so far. This is just my suggestion if it sounds illogic please disregard.

    Your suggestions are welcome. We have also received requests wherein people don't want their contributions disclosed. Anyway since this is a voluntary donation, we will post some kind of overall numbers in terms of collections versus target which should help.

    Based on just released information, it appears that India EB2 cutoff dates will advance, perhaps substantially, in May. China EB2 cutoff dates will also advance. The American Immigration Lawyers Association (AILA) reports that they were told the following by Charlie Oppenheim, Chief, Immigrant Visa Control and Reporting Division, U.S. Department of State:

    “[US]CIS says they have seen a decline in filings, and does not expect a change in the number use pattern. Therefore, this decline in EB-1 number use will allow me to begin having those ‘otherwise unused’ numbers drop down and be available for use in the EB-2 category. Based on current indications, that would mean that at least 12,000 additional numbers will be available to the EB-2 category. This situation will allow me to advance the India EB-2 cut-off date for May. The reason being that all ‘otherwise unused’ numbers are provided strictly in priority date order, and the India demand has the largest concentration of early dates.”

    There have been two reasons for China and India EB2 cutoff dates not moving forward as rapidly as had been the case in the past. The first is the unusually high demand for EB1 numbers and the second has been the increased demand for EB2 numbers represented by EB3 to EB2 upgrades.

    The significance of this announcement is that it appears that the recent surge in demand for EB1 visa numbers has abated. The CIS reports that this demand slowed down in October, 2010 and has not resumed. Presumably, this means that substantially most the EB2 applicants who felt that they could upgrade to EB1 have now filed the petitions and had them adjudicated. If this is the case, then the number of unused EB1 numbers will increase back to previous levels and become available for use by EB2 applicants.

    Just because some one said, VDLRAO predicts right, he has become a Psycic Guru here. Please stop this. Every one keeps saying , he predicts everything right. Did he predict, EB2 with PD2006 will be processed before EB2 with PD 2003. Come on Guys, Give me a break and stop this rubbish. What did he predict and on what basis. I dont have anything personal here, I appreciate him, taking efforts to come up with some number based on the calculation. But Please stop spreading this on every forum that He predicts right.

    I had my visa interview in Mumbai on Dec 28th. A PIMS Verfication was required for them to be able to issue me a visa. This is for an H1-B extension of stay - My six years expired in Nov. 2007 and my green card is in process.

    I was told the time they are taking for procesing is 48 hours but I still have not received any notification to take my papers to the VFS center.

    Has anyone in this situation already received their visa and stamped passport and if so how long did it take?

    Opened SR 9/5/2009...got letter from CRIS...wait 6 months.
    For my wife , we got 60 days wait letter.
    I m the primary applicant!

    Well even if you use AP, you need a passport, dont you? And the passport must be with the Consulate pending stamping. So one way to get the passport back is to withdraw the visa application.

    A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?

    hi singhv,

    no. VO said.."its approved and you should receive it by courier within a couple of days" now the embassy inquiry centre do not tell me why its delayed..i asked me them is it PIMS or some thing else..they say "sorry maam, we cannot say"
    i got no email, no slip, so i dont know if its stuck in PIMS or some checks ???

    And if its really NOT PIMS and something else, then how long does one estimate ?? how long could an administrative processing take ? how long could security check take ? how long could name check take ? etc etc..

    House Majority leader Tom Delay has resigned and will not seek the Majority post until next year. See here:

    The house republicans will move to start working on electing a new house majority leader. Tom Delay was considered to be anti-immigration that tightened immigration laws according to anti-immigration organizations like www.numbersusa.com. He voted in favor of HR 4437 that is a nightmare for illegal immigration but does not address the ones already here illegally. And no, there is no mention of legal immigration facing backlogs in this bill either. Just enforcement to crackdown on illegal immigration. Voting "Yes" by any congressman on HR 4437 should not be construed as either supporting or opposing the legal immigration and/or retrogression relief.

    There are 3 house members likely to seek the position and replace Tom Delay:

    1. Roy Blunt (Missouri's 7th District). http://www.blunt.house.gov/

    Roy Blunt has gotten poor grades from Anti-immigration orgs. However he voted to support HR 4437 that deals will illegal immigration. His views on legal immigration are unpredictable at best.

    2. John Boehner (Ohio's 8th District). http://johnboehner.house.gov/

    John Boehner has scored poor grades like Roy Blunt on immigration issues from Anti-immigration sites. However he too has voted to support HR 4437. His views on legal kind of immigration are again unknown at best.

    3. Jeff Flake (Arizona's 6th District). http://www.house.gov/flake/

    This is interesting. Jeff Flake is considered against immigration by Anti-immigration orgs. He got 100% marks by their grading system (God only knows how that grading system works on numbersusa.com, but whatever). He also voted to support HR 4437.

    However he has co-sponsored a bill along with Ted Kennedy, Joe Lieberman, Sam Brownback, Jim Kolbe etc that deals comprehensively with immigration problem in this country, both the legal and the illegal variety. See that here: http://kennedy.senate.gov/~kennedy/statements/05/05/2005512A04.html

    Title VI describes proposals for retrogression relief.:) :)

    Jeff Flake is one of the saner and more pragmatic voices in immigration debate. While he wants to crackdown on the illegal variety, he also understands the other reform need in other areas of immigration.

    Flying through Asian Countires is not an option for people residing in East Coast. I am travelling to India in the next week Via Amsterdam. I am told by the consulate that we do not need Transit Visas. My H1B Visa is expired and I am travelling on AP. Did any one hear differently?

    Thats correct - they don't need transit visas - I did in mid-Dec, 2007 - absolutely no hassle. Also, I find Schipol one of the most pleasant airports in Europe (barring Munich).

    My lawyer also uses fedex, I dont think fedex delivers on saturday so I guess I am fine , right ? (Unless fedex guy goes out of his way and delivers on saturday to improve his performance!!)

    Yes you are fine as long as he does not choose saturday delivery, which is very highly unlikely, and I guess he might be aware that the application should reach only on or after 1st july.

    We should write a letter to USCIS director & DOS(Oppenheim) copying Rep Lofgren etc. basically the content should say that any unused visa should be given to the oldest PD irrespective of Country/Category...

    We need some numbers to back this up. I think you are saying EB2 will not become current even with the recaptured number. There is another thread for requesting numbers from USCIS about pending applications per category, per country. So, participate in that campaign as well.

    We need the numbers. I would have guessed roughly 50% of pending 500K applications are from India, 50% of that is EB2, so recapture of 200K visas should help.

    I am saying Recapture will only help EB2 and not EB3. Bcoz all the recaptured numbers will be used by EB2 first. So EB2 dates will move forward and then people with PD in 2007 and 2008 in EB2 will use up captured numbers and EB3 will still be waiting to get any leftovers.
