    The law comes actually down to the following two rules:
    (1) horizontal spill if visas available
    (2) vertical spill for visas not required

    The language in (2) is much stronger. A visa number that is still available cannot be required at the same time. So one could argue that DOS is now misinterpreting the law.


    Everyone wants to interpret the law as per their wish. It is nature. However, there is a unbiased place to find the solution for right interpretation. That is called court. Discussing, how DOS/USCIS should interpret the (INA) law in this forum will not yield any result. Even if you contat DOS/USCIS, they will simply say "this is what we understand the law, we have no rights to change the law". Flower or letter campain will not work. If you feel the interpretation is wrong, the only solution is court.

    My recomendation is simple. To end retorgression in EB3, it just need more the number of visa. Current INA will not help EB3, and so DOS/USCIS. Only law makers can help to change the situation, by adding appropirate provisions in INA to create more numbers in EB3. Contact law makers. This is the good way of spending your effort. USCIS/DOS does not have enough power to change the law.

    The argument is same for why labor substitution was done away with. The bottom line is it was abused.
    but why do you think this is an example of the system being gamed?

    The IT consulting firm or whatever is willing to hire an experienced employee with more than X years experience for a job requiring more than 5 years experience. As long as this employer does everything by the book, and the prospective employee does everything by the book, what is wrong with this? Note that the prospective employee has still waited for about 5-6 years to get his GC, its not as if they are getting it within a year of applying.

    [Note that if the IT firm is taking any money from the prospective employee whatsoever for the labor application, then that is against the labor regulations (at least I think this was part of the new regulations that got rid of labor sub)]

    So where is the gaming? Also, assuming that you are saying the employer is taking money and creating artificial jobs then is this thing not a DoL and labor app problem as opposed to a lawsuit problem? I am confused. Please explain.

    All,

    I will once again be writing and sending posters to all the reps. This is one of our chances where we can get closest. If we miss this then there will be lots of uncertainity. Imagine we already missed it. See how desperate all can get.

    We have some time, Lets all spend considerable time this weekend, get bigger charts, use lots of good eye catching color, make our voices heard. Spend considderable time this weekend on this, please. Together we all can make a difference. Please do your best and spread this across your friends also who are waiting or have got their greencards. This one thing sucked up so much energy from so many here. Please support EB2 and EB3. How does one get these greens. I never got any.. :(.

    Hello, I can understand your pain as I was in a similar situation as you are. I would recommend to wait for atleast 2 weeks. I interviewed on 28th Dec and finally got the email on 9th Jan and the pp stamped on 10th Jan and took the flight on 12th Jan.

    If you have an upcoming travel which is in next week, please try to reschedule it as it is not certain on how much time does it take in such cases.

    I do not think getting the employer involved into this will help. VFS office will have no clue on this and they will answer only Questions on the process. Writing to the US consulate will also give you a general answer. It is sad that there is no accountability in cases like these. Please keep the faith.


    I am in the same situation. Appeared for interview on 8th jan in Mumbai. They returned my PP, I-797 with a yellow paper and asked me to wait for email. Haven't recieved any email yet. Do I need to contact my employer? Does my employer need to call someone in US for approval? Or shall I just keep waiting? It is very frustrating. I called VFS office but they don't know anything.. If anyone has received email or approval please keep us posted as this is the only source of information.

    May I ask you the reason for 4 year gap for I-140 filing? Are you using Labor Substitution?

    Since you are waiting for decade, I assume your PD is 1998 or 1999. Is that correct?

    I don't think so EB2 will make any difference.Its the matter of when they lay their hands on your packet and open it.
    Also I have a friend 2nd July Filer filed from NSC and got transferred to TSC , he received his receipts last week and good thing was after two days he had EAD cards sitting in his mailbox too.
    The TSC maybe slow in opening the packages but they are fast in sending FPs and EADs.
    So hang in there and hopefully you get everything soon.

    I was told if you are going back to your home country, even if you don't have valid US Visa stamped, you don't need a transit visa. When you come back ofcourse you will have a vaild US visa

    No I don't. You basically don't want to keep the door open wide. Once you are IN you want the door to be closed. You don't worry about loosing US jobs to India/China, but you don't want Indians/Chinese to enter USA and enjoy the "quality of life" you enjoy here.

    Nobody enters USA to live a "low profile" life.

    You are getting dangerously accustomed to the "taking things for granted" style. You are loosing your competitive skills.

    I personally know that more energetic people coming in is kind of dangerous even for my job safety-net (basically I cannot take things for granted). But I still have not learned to think beyond humanity, and I believe sharing is good. The new guys also deserve the chance for American dream.

    And I don't forget that I was also once in H1B, and came with a lot of dreams and skills.

    However, my point is, if you want to outsource take the job to the low wage country. Do not bring low wages here. I am ok if outsourcing would increase because of the Grassley bill. I am not ok if the low wages are dumped in here. I hope you people see the difference.

    I got my physical card yesterday but the last name is mis-spelled. What do I need to do and also has anyone experienced this? Also any thoughts on how long it will take to fix the name?

    Hi guys,

    I sent in the four letters 2 weeks ago and this week I got a mail from TEXAS Service Center. They returned my letter in original and they also wrote a big one page letter.

    I don't have it with me right now but in it, it was mentioned that "Please call us at our inquiry center if you have any inquires or you can check your status online as well as the recent processing times.

    Don't know if others are also receiving the same returned mail but I wanted to let you guys know this as an FYI.

    It does not seem like the letter reached the person to whom it was directed to.
