    When I cancelled in Mar-09 , my experience was different. The CS was humble and only persuaded me not to leave. But the cancellation process went smooth.

    FYI...I heard from some of my friends that Vonage is good as long as you are its customer. Once you call CS and tell them you are leaving...they play all sorts of dirty tricks.

    In reality How USCIS divide 28.6% among countires - That is unknown mystery and nobody surely know that. And that is why I had to assume "equal shares - 5 part" in my analysis assuming USCIS works fairly but we all know that is a bullshit too :)

    Look at histrocial approval you will know your assumption is incorrect. ROW gets more than half the numbers in any category.

    Was any one successfully receive a visa stamp after being referred to PIMS system?
    What is the time line for such visa stamps?

    I called DOS and they r just saying that they have't gotten to verifying my data yet in PIMS coz it's not yet available.. it's been a month 13 days and counting since my visa appearance..

    Ask your attorney to resolve this through AILA.

    Same here, i got a similar response too... If they are true to their words abt under review, we shud b fine...

    But the problem is, they mite b stating this under review for all cases to avoid repeated requests and hence the issue..

    Is ur case also at NSC?

    How has ur luck been with the POJ method? Have u always recvd the same informn from all IOs?
    I always get a different response wen i talk to an IO at NSC...

    I got to know that my case is pre-adjudicated and with IO since Sept 20, 2009. But this information is not helpful at all as people have got GC's as early as Sept 01.
    Now, whenever I call-I get same msg- that my case is with IO and nothing can be done be done to expedite it.
    I have changed my employer only once since filing for 485 and been only with Fortune 500 companies as permanent employees,don't know what is holding up the case- all my coworkers got it by Sept 15th.
    My case is at NSC.

    question: can I file without employer letter
    For an employment-based petition, in order to proceed and be valid,
    they
    need to still INTEND to be employed by the sponsoring employer if and
    when
    they get their green card. The employer however, does not need to sign
    any
    forms per se with relation to the adjustment petition. If the alien is
    currently working for the sponsoring employer (on H-1B or other) he or
    she
    can port or transfer employers without penalty or without losing the
    green
    card process 180 days after they file the I-485 petition. At that
    point,
    they can change employers and work for whomever they wish (provided
    they
    have a valid work permit)

    The forms which need to be filed with the I-485 include;

    Form I-485 for EACH applicant with $325 filing fee ($225 if under age
    14)
    Proof of approved I-140
    Form G-325A for each applicant
    G-28, if attorney involved
    Form I765 Work Permit (optional) (filing fee of $180)
    Form I-131 Travel Permit (optional) (filing fee of $170)
    Fingerprint fee of $70 for each
    Medical examination by INS approved doctor
    Passport, visa, approval notices and I-94 card showing all years in the
    US
    in valid status and maintenance of status
    Marriage certificate, birth certificates of children.
    Form I-134 Affidavit of Support (notarized) or I-864, with tax returns
    (1
    year must be attached, but income for three years must be listed); job
    letter from the alien's current employer; and pay-stubs.
    If the alien is NOT yet working for the sponsoring employer, I like to
    include a letter from the employer stating that if and when the alien
    gets
    his residency, they still intend to hire him or her.

    Sunny and Rolling came out as selfish to the majority of the members because they just focused on their issues first and identified some of the root causes for their long wait.
    I think we should all atleast encourage them in their pursuit for justice. We have nothing to lose. When a specific group works on an issue which is affecting them most they would do the best to get that fixed.
    This would motivate other smaller groups with other issues to take up theirs seperately. The more this happens the more heat it will generate on these 3 agencies DOL, USCIS and DOS.
    Then we as a bigger organization can work much faster on getting the bigger issues resolved which in turn will fix lots of these smaller things in the system.
    These kind of initatives are a win win for everybody. Every small step would help us go move towards our goal instead of trying to take one gaint step and getting bogged down.

    PS: Waiting for miracles is onething for people who trust in God
    But acting on ones own issue can get them closer to that miracle

    Not a lawyer, obviously :) , but the first line on I-9 about discrimination covers "hiring, discharging, or recruiting or referring... It is illegal to discriminate against work eligible individuals."

    Yes, "Interviewing" is not written there. And we all know that "Recruiting" or "Hiring" is not equivalent of "interviewing"

    Do you what you are talking about? One more term for GOP is a disaster. McCain would do nothing but spending more money on Iraq. There is no policy for John McCain. His only aim to continue Iraq war for 4 more years, and if possible, another four more years. They DON'T support same sex marriages. Remember! they are conservatives for God's sake. Republican party is good for oil companies and big corporates. For normal people like us, and specially for an immigration community, it would be an irreversible damage.

    Interesting that your handle is seekerofpeace. I hope you are at peace in any fight for justice.

    Communist/progressive leaning organizations such as ASHA and AID are fighting, doing activism, struggling and all doing all that, with a subconscious unhealthy feverishness in the mind. The long term result of their noble goals tends not to promote peace but a latent violence (does not have to be manifest violence).

    It is possible to bring justice with inner peace but at the same time steadfast determination.

    I am writing not directing to SOP who I wish only the best, but to bring about these subtle points.

    Very well said.
    1. DOS has to move fast in May to test if there are hidden demand (ppl who missed 07/2007 filing, porting, dependent filing). Those new filing cannot get be approved before October 2011. So they can move up to Nov/Dec 2006 safely in May. Also DOS/CIS, who communicate with each other for sure, will know they should process those pre-adjudicated cased first to clear the inventory.
    2. In June, July, August, they could be cautious but still move ahead up to March 2007.
    3. September is critical, as that time, if DOS doesn't want to waste any quota, (100% CIS cannot approve any cased filed in that month), they have to move to a point to get all quota used. Based on 12K/half year, or 12K/year from EB1, say 20K be safe this year from EB1. 7K from EB2 ROW as last year, 8K from EB3, 0 from FB (EB2 get only 10k/4 last year as 10K FB is divided by Eb1/2/3/4), and normal 2.8K for EB2 I/C each (6K total), there are total 41K possibly for EB2 I/C.
    4. Porting (6K this year), New filing (ppl who missed 07/07 with PD before 07/07), could have a negative efffect
    5. The inventory for EB2 I/C is about 34K before 07/2007 (based on DOS October/2010 and CIS inventory)
    6. This is very close. Will DOS move beyond 07/2007 a little to allow new filings (those won't get approved in Sept) and also make CIS easier to clear all 07/2007? This will be a judgement call. I am 50/50 on that.
    7. There are many factors that will play in the scenario.. But I am sure EB2 I/C 09/2011 PD will be pass
    May 2007 100%
    June 2007 80%
    July 2007 60%
    Sept 2007 30%
    Nov 2007 10%
    Dec 2007 or Current 0% (DOS/CIS learned the lesson)
