Hi UN,
Sorry to post here. I have posted in some other thread but no response.
I just got my FP notice for Aug 23rd for myself, spouse and 8yrs old son.My wife and son is in India, we cancelled our trip back in May for my 485.We waited till we got our receipts, they went to India for some important work.At this point they cann't make it by Aug 23rd. They both have valid H4 I797 with them.
Can you please advice, what is the best procedure to follow here.
1. Can I take my FP and request to postpone of my wife & son ?
2. Postpone for all three members, and request for a later date ?
3. Can we go after Sep3rd with the old receipts dated for Aug 23rd 2007?
Thanks In Advance,
kSR

Pappu,
Could you please outline what you would you say about helping EB-3 out when you meet with DOL/USCIS officials next time IV meets them...also I want you to write a full letter that address the issue faced by Eb-3 and post it for us to mail it out...I understand that letter is not perfect..but it brings the dire picture of EB-3-I..
From what I have seen in the Fourm posts nobody clearly knows how these Visa numbers are clearly allocated and everybody has thier own theory..and you know well legislation will not come this year and we do not know the composition of new congress next year..we may have a congress that even more anti-immigrant with the slowing economy.. and EB-3 I is badly hurting..
We cant convert to Eb-2 now its too late..LC PERM are getting Audited (Taking 8-9 months ) and no PP for I-140..even if we apply for Eb-2 now...by the time it comes ..we dont know whether Eb-3 would have moved to say 2003 making all the PERM and I-140($$) efforts go waste...
We want to know what is in store for EB-3...some folks write that only 5 families per state are going to get thier GC in EB-3.. at the current rate 2001 Eb-3 have to wait another 5 years to get thier numbers....
Could you in your next meeting with DOL/USCIS/DOS please bring up the issues with EB-3 now that EB-2 has some relief..and give us whether we need to convert to EB-2 or in the near future will the numbers in EB-3 move..
Frankly I have no enegery left ...
Pappu..you are doing a great job..I commend your efforts..please show some direction for EB-3 ..some news from DOS/USCIS would be helpful...
I have my disagreements with the letter content and have let it known in my posts on the thread.
Pani you are an old IV member with IV experience and I trust that you would give second thoughts based on my comments.

One of the qualifying criteria for EB2 is 5 years of experience. Right????
If your I-485 application is stuck since July 2003 or prior, you are automatically EB2 by that rule. Are you not? You have been working for 5 years atleast.
The revised rule should be
EB2 eligibile = Anybody with experience on labor > 5 years (this would not impact current EB2 folks) or whose labor is older than 5 years (this will make EB3 folks happier).
Peace.

Why are be debating 3 - 4 years rent vs own? As the subject indicates "long" term prospects of buying a home..we of all the ppl should know the meaning of the word "long" based on our "long" wait for PD (which I think should be renamed to retrogress date because I see nothing priority about it)..the point being lets debate 10 years rent vs own..as against 3-4...I think over a 10 year timeline the buyers would come out ahead of the renters..maybe not in CA but in other states that's quite likely..
I agree that over 10 years buyers "may" come ahead of renters but our question is will buyers of : 2009 come out ahead of 2010 buyers or 2011 buyers? Also is it worth taking a risk and wait 1-2 years given the state of economy and our GC in limbo.
I have been paying rent since 2001 and my friends bought houses in 2004 & 2007. None at the moment think they are ahead of me due to their decision :) :p

A man dies and goes to hell. There he finds that there is a different hell for each country. He goes to the German hell and asks, "What do they do here?" He told," First they put you in an electric chair for an hour. Then they lay you on a bed of nails for another hour. Then the German devil comes in and beats you for the rest of the day."
The man does not like the sound of that at all, so he moves on. He checks out the USA hell as well as the Russian hell and many more. He discovers that they are all more or less the same as the German hell.
Then he comes to the Indian hell and finds that there is a long line of people waiting to get in. Amazed, he asks, "What do they do here?" He told, "First they put you in an electric chair for an hour. Then they lay you on a bed of nails for another hour. Then the Indian devil comes in and beats you for the rest of the day." "But that is exactly the same as all the other hells - why are there so many people waiting to get in?"
"Because maintenance is so bad that the electric chair does not work, someone has stolen all the nails from the bed, and the devil is a Software Engineer , so he comes in, signs the register and then goes to the Cafeteria!!! !!

Unfortunately, there are no simple answers. Mortgage rates are tied to 10 year bond rate, so they generally are not affected much by short term fed rate. With credit crunch, bond market is in real bad shape.
Fed is trying to supply short term funds to ease this crunch. I don't know how low Fed will go for this. What I am seeing is mortgage rates being stable or going down a little in near term bcoz of Fed easing. For long term, I believe rates will go up as bonds have to become attractive to get new investors. This may not be the best ( absolute bottom) but definitely very good time to refinance if it makes sense for your conditions.
For first time buyers like me, there are a lot of parameters to be considered. In my opinion the parameters are tilted towards faster house price drop . Hence I am waiting at least for a year. I will not do anything till next spring.
> Hence I am waiting at least for a year. I will not do anything till next spring.
Perfect ....exactly the same timeline for me too. I guess by that time GC picture and economy picture will be more clear too !!
This is from CEO of Lennar builders
------------
"Lower consumer confidence has quieted demand among prospective homebuyers and deterred them from a buying decision, while contraction in the lending markets has reduced the availability of credit for those prospective homebuyers that do wish to buy a home," CEO Stuart Miller said in a statement.
Miller added that the glut of homes on the market continues to rise due to foreclosures and homeowners who have been forced to dump homes they can no longer afford.
"The housing industry continues to be impacted by an unfavorable supply and demand relationship, which restricts the volume of new home sales and, concurrently, depresses home prices in most markets across the country," he said.

Guys,
Looks like we may see some action from India within hours now. The war clouds have been gathering ever since the Mumbai attacks. But now the signs of an imminent war are unmistakable.
Apparently India had given pak a deadline of one month to hand over the perpetrators of this attack. The deadline expires on December 26th.
Both India and pak have canceled the leaves of their military personnel.
People in border villages of Rajasthan are evacuating.
CNN has been reporting that paki troops are on the move.
If my hunch in right, something big will happen in next 24 hours.

We've been trying to save money because the mortgage payments ...
... were pretty tough to work with. I don't reckon I drink too much beer, maybe a carton on weekends with the boys, but she told me we couldn't afford beer anymore. Well, it was tough, but I quit.
Then the credit card statement came in, with $150 spent on cosmetics. So I asked how come I had to give up stuff but she didn't. She said she needed the make-up to look pretty for me.
I told her that was what the beer was for.
I don't think she's coming back.

Our Nation as a Startup (http://blogs.wsj.com/indiarealtime/2010/12/29/india-journal-our-nation-as-a-startup/) By Rajeev Mantri | IndiaRealTime
Doing business in India can be overwhelming for somebody accustomed to working in a more hospitable business environment. The World Banks Doing Business study ranks India 134th worldwide for ease of doing business, behind lesser-talked- about nations such as Tanzania and Ghana.
Besides the well-documented inadequacy of physical infrastructure, archaic corporate and taxation laws are yet to catch up with modern ways of structuring and operating new ventures. Yet India is able to register high rates of economic growth year after year.
U.S. President Barack Obamas contention that India has already arrived is magnanimous India is a startup with high potential but hasnt made it yet into the pantheon of world powers. Like a startup, India is chaotic and unpredictable.
Democracy adds another twist in the tale. As the last three months have shown, Indian politics can turn on a dime and the perception of political stability can give way very quickly. Indias business model is contrary to how other Asian economies have developed: India continues to be services-driven and domestically-oriented instead of being heavy on export-led manufacturing.
This approach shielded the economy during the financial crisis. With growth driven by high-quality entrepreneurs who have been able to deliver despite a suspicious and often obstructionist state, its no wonder that investors continue to be bullish on India and tend to overlook major political and geopolitical risks.
But high growth brings with it many quandaries. Though a happy problem to have, a growing enterprise faces its own management challenges. At the very least, the capacity of Indias executives and government to manage growth has been somewhat disappointing. India chose (some would argue that it stumbled upon) a bottom-up development model based upon entrepreneurship.
We are now reaching a stage in the economic cycle where we need to push the envelop further, not negate the strategy that has served us very well over the last two decades. India saw two bursts of significant reform, from 1991 to 1996 under Prime Minister P.V. Narasimha Rao and again from 1998 to 2004 under Prime Minister A.B. Vajpayee. Since 2004, there has been virtually no reform initiated by the Congress-led United Progressive Alliance government in areas such as labor law, where the current regime is constraining growth in manufacturing. This is impairing the quality of Indias economic growth and limiting job creation.
Recently, Steve Jobs said that his company, Apple, is the worlds largest startup. Its an interesting view given that Apples market capitalization, which is close to $300 billion, makes it one of the most valuable companies in the world. Apple also has zero debt and tens of billions of dollars in cash. From the brink of bankruptcy and irrelevance in 1998, Apples financial and competitive strength is now the envy of the technology industry.
When Mr. Jobs returned as Apples CEO, he had a straightforward mantra: To rebuild Apple as a pioneering innovator and rescue it from the morass of creating me-too products, as he put it. He felt that the company he founded had forgotten what it stood for. This was audacious for a company struggling to stay on its feet.
Indian administrators and policy-makers should also remember how high rates of economic growth have been achieved in the first place. Like a startup which has achieved a fit between product and market fit and is ready to scale up, India needs to continue providing its entrepreneurs with the space and environment to operate.
Apple lost its mojo because it abandoned the strategy that made it what it was. Curiously, that strategy itself was not rigid and inflexible but one of continuous innovation, where Apple would make its products irrelevant before its competitors could. A return to this thinking has ensured the companys rise through the 2000s. India, too, needs to return to policies that have transformed its economy from anemic to blistering growth.
In Hindu philosophy, The Upanishads talk of the concept of Atmanam Viddhi, which roughly translates as knowing oneself. It turns out that self-knowledge is also a sound business strategy to reach where you want to go, its first important to know how you got to where you are.
The government must realize what it is that has delivered high rates of economic growth. Negating the ideas and policies that are driving Indias economic development by delaying the next round of economic reforms could prove to be immensely damaging to Indias economic prospects. India needs a visionary leader to step up and push through some of the changes that most agree need to be implemented but few have the political courage to execute or else an opportunity may be lost again.

India vs. China in 2010 (http://blogs.wsj.com/indiarealtime/2010/12/30/india-vs-china-in-2010/) By Tripti Lahiri | IndiaRealTime
Economists and western political leaders love to compare India and China, and its an understandably irresistible comparison: Theyre both rising Asian economies with more than a billion people, and neighbors to boot.
On India Real Time weve done a little of that ourselves from time to time.
If youre pressed for time we can sum it up like this: China has more of everything (except poor people.) If youre not, here are five blogs that stacked India and China up against each other on different indicators in the past year.
Warren Buffett: The billionaire from Omaha so far has appeared to be leaning a bit more towards China, at least in terms of investments. Mr. Buffetts company, Berkshire Hathaway Co., holds a sizeable stake in Chinese battery and auto-maker BYD Co. And Mr. Buffett visited in September, along with Bill Gates, hoping to convince Chinese billionaires to give away more of their wealth to charity. The love is returned, with a Chinese man having paid a record $2.1 million to have a one-on-one lunch with the investing wizard.
Mr. Buffett has said that hed like to invest in India but his plans have been stymied by caps on foreign holdings in insurance.
However, India can at least look forward to hosting him in the new year. The billionaire announced at a shareholders meeting this year, in response to a question from a young Indian-American, that he plans to visit India in 2011, perhaps in March.
The big-ticket event: India hosted the Commonwealth Games in October, China hosted the Asian Games in November. Of course, Chinas already hosted the Olympicsand howso it hardly seems fair to compare the two.
But we did anyway. The news coverage of the Indian Games was rife with words like delays, corruption, shambles (were pretty sure that was the British press) and filthy until the opening night extravaganza quelled criticism for a bit.
China, it appeared, had lovely, shiny venues ready to go about five months ahead of the event, so it could spend the final days flicking away little specks of dust from its Games merchandise.
Their middle classes: According to a report on Asias middle classes this year, India still has about 650 million people living on under $2 dollars a day measured in 2005 purchasing parity dollars.
China now has less than 100 million living on that amount. Yet there was a time, as recently as the 1990s, when the two countries had similar numbers of poor. China has just done a better job of lifting people from that bracket into the middle class, and not just onto the next rung the $2 to $4 range, where a majority of Indias middle class folks fall.
The majority of Chinese now fall in the mid middle class category that can spend $5 to $10, a group whose numbers appear to have quadrupled between 1995 and 2007.
But dont blame the slower rate of reduction in poverty on Indias political system, says John Lee of the Sydney-based think-tank Center for Independent Studies.
The economy, stupid: China is still a much bigger economy than India, even though the two countries have roughly similar numbers of people. At a Hindustan Times conference on India, Shashi Ruia, chairman of Essar Group, compared the two countries on steel production, car production and trade.
As we already said, China does more of everything. The gap is undoubtedly glaring on roads, electricity production, trains and other infrastructure.
Surfing: Indias and Chinas online populations belong to different worlds, judging by their Google searches. India appears to be firmly embedded in the English-speaking western world, looking for products like Nokia and applications like Facebook, Yahoo! and YouTube, although when it comes to films, its all Bollywood. China seemed to be the reverserelying largely on Chinese applications but much more likely to seek out Hollywood films. They did have this much in common though: outr pop star Lady Gaga.

So, you want to remove the threat of nuclear weapons by using them?
Well, remove the threat by telling Clearly and unmistakably that use of nuclear weapon by Pakistan would invite catastrophic counter attack. Not by using it. Remember, India has "no first use" policy....
Otherwise what happens...Pak would keep taunting that " Hey, remember we have nukes...wanna pick a fight with us?" and keep doing what they are doing. They are trying to take the option of war OFF the table. India should keep it in the table but use very very cautiously.
Peace again,
G

There has never been a mention of the H1b visas approved and those that do not fall under the quota....
This guy is just after his ratings nothing else...his book explicitly quotes that H1b and L1 visa holders do not pay any taxes and transfer all the money home. (CNN has a few hundreds of them on H1b)
When there was a huge debate on illegal immigration he quoted he was all for legal immigration. The only way one can legally immigrate with skills is via H1b visa and he is against it.
When the debate is on illegal immigration, the former immigrants and their descendants will chant "We love legal immigrants". When the focus shifts to legal immigration, suddenly they don't want any immigration. Their argument is "If bus is full , we don't need more passengers" . Likewise USA is "full" with former immigrants and their descendants , so don't need more immigration.
If supply is squeezed somehow, the demand will increase. But poor fellows, if businesses can't get qualified numbers , it will accelerate outsourcing.

On TV, when someone barks without any research backing it up, there is no one to counter him.
Only few shows have a chance to counter, but again the anchor is so smart that he will make sure that his guest receives little time to attack the host.
Guys the world is all about who is powerfull.
It is time to go to gym.
bye
How the hell did he arrive at that figure ? the whole trouble with lou is he fabricates "research" such as the above statement with absolutely nothing to back it up. So much for the Harvard educated economist in him.

Besides other errors in calculation which have been already discussed above, the numbers assumed here are unrealistic.
First and foremost you can't get townhome in Cupertino for 500K. Even in this market 2br/2bth dingy condos in good school district in Cupertino (remember, even within cupertino there are different levels of school district, especially when it comes to high school) are going for 550K at least.
Second for those condos HOA is on an average 400/mo so that's minimum 4800 per year not 3000.
Also the biggest problem with this calculation is it is valid for the very first year ONLY. The 15K you get back from tax credit and 50% from the broker (IF you can get it in the first place) is only for the very first year. What are you going to do for the next 29 years? Unless you think you will own for just one year and then flip it (which is a suicidal plan in this housing economy) it does not make sense.
Here is one calculation that might give you one more reason to buy...
This is taking into consideration bay area good school district ....
say you are currently in a 2 bedroom paying around $1900 rent (say cupertino school district)
you buy a townhome for around $500k putting down 20%
so loan amount is 400k
@ 5% instrest your annual intrest is $ 20k.
Say 3k HOA anually...
Property tax....as a rule of thumb, I believe (and have heard from others) whatever poperty tax you pay comes back as your mortgage intrest and property tax is deductable.
So not taking property tax into account....your annual expense is 23k.
now here is the nice part....
you get 8k (or is it 7.5k ?) from FED for buying a house (first time buyer)
If you get a real estate agent who is ready to give you 50% back on the comission you can get back around 7.5k (assuming the agent gets 3% comission)...I know those kind of agent exist for sure !!
There is something I have heard about CA also giving you 10k for buying new homes...but I am not sure of this so will leave it out of the calculations...
so total amount u get back....8k+ 7.5k = 15k approx..
1st year expense = 23k
1st year actual expense = 23-15 = 8 k
which mean monthly rent = 8k/12 = $666 per month (it is like paying $666 rent for a 2 bedroom in cupertino school district)
Will the property value go up ? I do not know (I wish I knew)...
Is there a risk ? I would think yes....
Percentage of risk ? I would think keeping in mind current prices the risk is low...
I am not telling that you should buy or not buy....just provided one piece of the calculation....-;)
All the best !

Hi,
I applied for GC under schedule A in may06 .My husband filed as derivative. He received a notice of intent to denial last month .Reason being he did not have paystubs for a period of more than 6 months during 2000 and 2001.His employer at that time did not pay him even after he worked for 4 months then he took few more months to change his company(more than 180 days)In 2002 he went to India and came back .and in 2004 filed for a GC as primary petitioner and me as a derivative .last year he withdrew the petition after he received several RFE`S fearing the worst.Even though he no longer has GC filed as primary petitioner he received notice of intent to deny for the petion filed through me saying that his H1 was not legal as could`nt show proof for several months and that when he filed for AOS he used those years as work experience.
and now another problem is I applied for EAD in march and have not received new ead.my old ead expired 10 days ago.and now Iam not working.
We bought a house last year thinking that under schedule A we`ll get GC in no time. Now we know it is a terrible mistake. Now both of us can`t work and had to take my son out of daycare. and we have house payments to make.We put our house for sale weeks ago and so far no offers.I contacted local representative to expedite My EAD and also contacted USCIS to expedite it,
citing financial burden. We are spending sleepless nights and have no clue what to do for my EAD and his AOS.pLEASE HELP.
Did anyone face similar situation .Any suggestions are welcome.
