I understand you don�t care about the United States and its people and you�re only interested in what you can gain from them but if you weren�t so blinded by greed you�d see this is something else they can give to you. Now I know why I took the route I did, I would have accomplished far less in my personal life with the likes of you. In fact, I may doing to much sharing my expertise with you. I refuse to have my name tarnished any further. Besides, you�re only a beginner. What was I thinking? IV really ought to make it clear to everyone that this is an amateur site. Should we be worried about the DREAM ACT?
As far as I know dream act does not offer anything for legal kids. Its all about kids of undocumented workers.
I am not quite sure why should I support this bill. Unless this bill includes age out protections for legal kids or legal kids get the same benefits as kids of undocumented workers, I don't think many people would support this.
Please let me know if you know any provisions that help us or hurt us . I am open to change the mind ...

....I am not sure why someone is portraying Infy or Wipro as companies that go for "Easy money..." that's completely ridiculous. Agreed they are not doing lots of so called high-end R & D projects and majority of thier revenue is still from service industry. But that does not make these companies any lesser.
I am not sure how much insight you guys got into these companies, but they are doing quite a lot of good assignments. Also, the processes they got in place & the maturity they show in execution of assignments is definitely on par with any other software services company in the world.
Probably a bunch of you folks are frustrated with these companies because the billing rates are driven down & opportunites in US (for consultants) are becoming less due to these companies' offshore model - but that does not make these companies shallow as you are trying to portray.
PS: I am not an employee with either of these companies. FOr that matter, none of these offshore-based companies. But the facts are to be accepted.

Can anyone please comment if the advise given by my attorney is accurates (ability to file new I-140 with the MTR/Appeal for the older I-140?

Thanks for your thoughts & advise. It helped me in my conversation with my company's attorney. I would first like to clear my educational background. I have 10 + 2( HSC/ 12th Grade) + 1 (1st year of Bachelors of Commerce) + 3 year Diploma in my field. That being said this is what she has advised/recommended.
She states that she is fairly confident that we can argue successfully the denial. She has said that she will file an MTR/Appeal & at the same time file a new I-140 too. She says she thinks there is a 50% chance that the MTR would be successful, if not she said it will go for appeal & take about a year. The advantage she said of filing a new I-140 at the same time is that she can make an airtight case with the cover letter covering the points for the reason for the denial of this I140 & the decision on the new I-140 would be fairly quick if the appeal is denied as it was filed witht eh appeal for the old one. The only disadvantage with a new I-140 would be that we cant file for 485 till there is an open visa, which means no EAD/AP for myself & my wife.
Can members with knowledge of these kind of scenarios shed some of their thoughts?

India rejected both Boeing and Lockheed Martin's proposal of fighters . I am not debating the reasons or the merits of this decision if this was right or wrong . I am just discussing the potential repercussions this has had so far and might have .
'Exclusion of US firms from IAF jet deal a setback for ties' (http://www.indianexpress.com/news/exclusion-of-us-firms-from-iaf-jet-deal-a-setback.../783401/)
1) The issue is so serious that Tim Roemer , US Ambassador to India submitted his resignation immediately since he was on the hook for making this deal work .This shows the measure of disappointment they had.
2) India was seeking US assurances in security a Permanent Security council seat , which looks far fetched now .
4) Pentagon , Whitehouse and the DoD very upset that deal fell through . This sentiment will certainly percolate to the USCIS and the State department and might embolden Anti Immigration senators whose measures will get more support in the house and senate.
5) Prosecution of companies entangled in cases like Infosys might find more support and favor with the Govt.
Question is how/if there will be a backlash against India / Indian's get back at us at least in the short term .Increased scrutiny and visa denials , PoE Harassment , GC audits etc.
Will the US take a Tit-for-Tat reaction on this issue is what remains to be seen.

According to the reports, India went with the technical evaluation where as US in the name of transparency wanted a political decision. There is also end-user agreement US wanted India to sign, which allows US to come and check the planes whenever and wherever it wanted to... so blaming India in this is not right... Yeah if the restriction was for non immigrants none of their "special" buddies from gulf states like UAE, Saudi, Kuwait etc would be able to visit.

what my friend was told...if you have given proper notice to quit...your employer has no legal standpoint to harras you.
dont worry abt that desi employer..that bum is in bigger soup than you are...the law that requires all employers to provide W2 before jan 31..no matter what..check with IRS if you want....he is toast! .;-)
take it easy.. you will be all right!

It defeats your H1B and Green card application. America invites H1Bs and gives them greencards not because they are paying taxes but because employers prove no american is available for our job and we have unique skills for job. My situation,
I am a july 2 filer, planning to use EAD to work in diifferent company in same profession(NOT invoking AC21). On I-485 approval want to come back to the original employer who filed I-485. my company is supporting and willing to support for any RFEs.
Please tell me if it is going to work and what are the risks involved.

Thanks friend. I do hope your prayers work for me. But I still find it strange that if someone has a pending I-485 through consular processing route, then he/she can't get a visitor visa no matter what? What if it is a medical crisis? Family reunion issues? This sure sucks. I will check with some lawyer on this.
And lastly what you detect as arrogance is my plain talking style. Did I make personal attack on anyone? no, right? Life is like a game of chess. Make the move which makes the best sense at any stage. What is the point in thinking about past moves?
I do respect your views and To me, life is little more "serious business and it deserves due respect than entertainment aspect of a game" :) I hope you would respect other's views on life too.
