Hi Shirdibaba,
Can you copy and paste the exact letter, i mean to ask the exact letter means does it contain any agent id.
1. Did you opened any SR in TSC around 10/14 or 10/15, We have a group of people who had the same problem in TSC during those days. all the letters replied by the same agent.
2. Find out from attorney if he charges any fee for this. If so please don't go with him.
take an info pass and find out the details.
This is the best way to find out. (As i told you the group of people got the same response, most of them took info pass and found that nothing wrong in their case)
Nothing to worry, most of the cases it might be a mistake by the agent. or in some cases it is pending for minor verification.
Hi, we have approved EAD and I 485 Pending. When called to find about the case they send the leter which says---
The status of the service request is: ur case is on holf becoz u appear 2 b inadmissible under the current law.Rather than denying ur application based on inadmissibilty,we r placing ur case on hold while the dept of homeland sec considers additional xcercise of the Sec of Homeland security's discretionary xemption authority.Such an xcercise of xemption might allow us to approve ur case"........................PLS ADVICE .What happend to ur case? What did ur lawyer advice.I have taken an appt. wt my lawyer but he is out of town and seems it will take sometime...

people,
please stop attacking for no good reason. i've been through this whole set of emotions too, and i'm pasting below a dialogue with Greg Siskind on his blog. Greg is a much respected figure in immigration law and does his bit and more to support our cause. please read it, he makes very valid points.
why are these kids our enemies anyway? they are stuck in a bad position and helping them get relief behoves us.
Paskal - The children of legal immigration applicants were specifically covered in the Child Status Protection Act passed earlier in this decade. They are now allowed to immigrate with their parents even if they turn 21 during the middle of the process, a key change designed to ensure that those here for years waiting on green cards could still benefit. There were other important benefits in this bill. read from the bottom up...
But on a separate note, strategically we saw what happened with CIR when we tried to get every fix on one bill. Three years of work down the drain. We need to get each fix done a little at a time and take what we can get each time and focus on getting more in the next battle. One week we have a victory for illegal immigrants. The next we win one for skilled workers. The next we help refugees and asylees. We need to cheer each victory rather than be upset that not every group was helped.

Greg,
I do not think people really oppose the relief being offered. Neither do they grudge the proccess of legalization for undocumented immigrants. However there is a great deal of heartburn over the way skilled workers are treated. Why can't this bill include legal children who have lived here most of their lives? kids have to "become illegal" to get benefits? what's the message?
Similarly in CIR, 90,000 GC a year for 5 years were offered for backlog reduction. Compare this to the almost 1 million FB relief and the 11 million GCs for legalization. what's more no one knows how many undocumented workerers there are. 11 or 13 million? so 2 million extra GC are just an asteriek to congress, and yet they won't give paltry increases to skilled workers to cover the backlogs?
this is the source of frustration that's manifesting in the comments you are reading.

Some have commented noting that DREAM might pass because it's advocates are showing passion. This should hopefully inspire you rather than upset you. Immigrants Voice has really given me hope that the skilled worker community finally is starting to find the passion that will change minds in Washington. To date, this community has largely depended on the advocacy efforts of groups like AILA and the ITAA rather than on the grass roots efforts of the community itself. These groups do a great job, but they can do so much more in partnership with an active immigrant community.

No one analysed the statue of the language used in 202 5 a.
If the total number of visas available under paragraph (1), (2), (3), (4), or (5).
You might have to define what the word "is" is ;-)
Anyway, that paragraph also states: "If the total number of visas available under paragraph (1), (2), (3), (4), or (5) [...] exceeds the number of qualified immigrants who may otherwise issued such visas,." but then continues on with: "the visas made available under that paragraph shall be issued without regard to the numerical limitation"
One could interpret this distinction such that the actual number of visas available is not necessarily the same number of visas made available, which is fixed to 28.6% + spill-over. It might, as well, comprise only those unused visas that haven't been passed down to a lower category. 203 (b) (2) / (3) and 202(5) seem to compete over the unused numbers. Not sure which one has preference.
This is the very direct, simple interpretation of 202 5 A.
Therefore one cannot (EB3-ROW) interpret, for their convenience.
Well, that's according to your interpretation. You seem to suggest that USCIS disagrees with your interpretation. We probably have to wait for the next immigration statistics to see what rule USCIS has been following.
Thats why I suggest the IV to discuss with experinced attorney and make a enquiry with law makers or DOS, if required. Otherwise (if it is wrong it is a big blow to India and China). We will get only 2800 per year.
I'd hope IV would focus on increasing the number of GCs available to all of us, instead of fighting for allocation. ACT-21 increased the number of H1B visas without increasing the number of GCs.

Dear IV folks,
After a long long 7 years I finally received my Green Card y'day.
If not anything... this process does forcefully teach patience, hope, anger mgnt & gives a new understanding of terms UNFAIR & UNJUST.
My app did experience all the delays ..Backlog centers, company change, date portability, NameCheck..
For expediting Namecheck & Serv. ticket I had written/fax/calls to almost everyone in govt. White House, First Lady, DHS Dir, TSC Dir, USCIS Dir, Senator...
Not sure if anything worked, but finally 180 day rule might have helped.
Finally ...it's a great sense of relief.
I was desperately needing it now as I wanted MBA loan & change of field etc.
Special thanks to pappu, logiclife, berkeleybee,Googler ...you guys are the lighthouses in this long tempest.
It's amazing that someone whom you don't know & have never met, inspire & guide so many others.
All the very best to everyone & I hope everyone gets their GC in a FAIR order - FIFO -.
God bless you all.

Shiller is smart but I think he is confusing the word 'Immigrant' with the word 'stupid'.
I am an immigrant and why should I buy an unaffordable over priced house which no American is willing to buy?
he is smart but his idea was stupid ..why will they allow anyone to come to US and give him GC on the first day just because he purchased a house ??
also the reality has changed somewhat as US loses its charm somewhat ..and as other countries become better ..many will not come and buy a house.
maybe we should have a campaign (or should have had a campaign) telling shiller that forget newcomers ..there are million of well to do immigrants in US who would buy a house EVENTUALLY if their GC's were to be processed faster !!

using a flash is ok, just be careful if you wear glasses (you might need some retakes before you get it right). and turn on red eye removal. 3.2 mp for the size (2x2) of picture is good enough.. Even 1 mp is good enough if you are zooming in to take pictures. but if you are cropping a 1 mp picture to take out surroundings, its better to use 2mp plus camera.
When using a flash you get harsher shadows, to counter that have light source both from left right and top and do the picture in daytime with atleast some natural light. Remember stand atleast 2 feet away from the white background.
Flash results specially in home environment without proper lighting won't be good at nighttime unless you use multiple synchronised flash guns.
I guess the other persons remark regarding flash may be related to lighting / over exposures/ shadows. (make sure you wipe your face if you have oily skin - no kidding )
In the end if you really want to make your pictures look good and per specifications go to a portrait studio.

This "me vs you" attitude is what is unhealthy. Having PD of June 2002 is nothing to be happy about, either for EB3-I or ROW. It is just pathetic. We should all be together in this. Asking for more visa numbers, recapture, etc would be more practical for us
I was answering in reference to his question.
For me, I want all categories to be current all the time :)

I think I have joined IV in last 3 years or so...
Donated money once & have called congressmen & senators many times ...
Could someone please tell me -
What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.
I have asked few friends to join IV but then if they ask me for IV accomplishments - i can't count any....
If IV has accomplished its objectives, then there is no need for any of us to join. But anyway, the following might be listed...hope this helps.
Immigration Voice Achievements
1. September 2009. Streamlining of Security Screening Process for Foreign Scientists: DHS reduced the wait times for Visa stamping in foreign consulates to 2 weeks. A successful campaign was run by IV members. http://immigrationvoice.org/forum/forum16-iv-agenda-and-legislative-updates/654080-iv-update-good-news-for-people-stuck-due-to-security-checks-while-waiting-for-visas.html
2. September, 2009. Successful completion of FOIA campaign: After filing hundreds of FOIA requests USCIS released the data of pending applications on their website. http://immigrationvoice.org/forum/forum16-iv-agenda-and-legislative-updates/630599-iv-update-on-visa-numbers-and-foia-data.html
3. 2008: Admin Fix campaign. 2 Year EAD announced by USCIS for all that have filed AOS.
4. 2008. Successful introduction of 3 bills in the House by Rep Zoe. Lofgren. Immigration Voice successfully advocated these bills, brought in co-sponsors and received support from other interests for these bills.

I’ve been reading too many posts, queries and concerns and feel that I am not sailing alone.
I have a few questions:
1) How does USCIS work? Do they have a set of rules? Is there a law stating they would provide AP or EAD (for all legal eligible cases) within 90, 120, 150 or 200 days?
2) How can a person who is trying to immigrate legally (tax paying) make USCIS answerable for all these delays?
3) Does the law of the land provide any opportunity for us (people trying to immigrate legally) to question USCIS for the delay?
I’m all questions. Please share your thoughts….
Thanks in Advance

3) Does the law of the land provide any opportunity for us (people trying to immigrate legally) to question USCIS for the delay?
I’m all questions. Please share your thoughts….
Thanks in Advance

Does that means that the existing backlog will be cleared fast?
Specter agreed this morning with Kennedy's approach, provided that these illegal immigrants would not be able to start legalization proceedings until the backlog of 3 million people now waiting in countries around the world for their chance to come to the United States legally get their green cards.
Any comments or thoughts on this is highly appreciated.
Thanks

And there's plenty of competition. Essentially, the bill makes the entire state a 287(g) state without the supervision of Department of Homeland Security. The bill's constitutionality seems extremely dubious, but we'll have to wait on the courts and I feel certain that a suit will be filed within days of the governor signing. Here is a summary of the bill's provisions. As an aside, I was struck by the "Profiles in Courage" passage from the LA Times coverage of the bill: [Governor] Brewer, a Republican, has not taken a public stance on the bill. She replaced Janet Napolitano, a Democrat...
