I personally think Mr. MPADAPA's assumption is wrong. Last year (2008), the spillover came from Family quota of 2008. Spillover from Family or Employment quota of a particular year cannot be given to the following year. So the fact that there is nothing left from the family quota of 2008 doesn't change any situation here.
So, this year the spillover that Employment category can get from Family quota will be the unused numbers of 2009 Family quota.
This is just my thought!

So if I'm understanding it correctly. For all the ones who applied for I-140 after May15th 07 all there petitions will be cancelled or revoked? I really that should come from the USCIS as a amendment and not from a news or a blog. I have been browsing the website and yet to find it. Can someone help me out with the exact text from USCIS? :mad:

Five reasons why I oppose immigration reform bill in its current form.
1. This bill in its current form does nothing to reduce the current backlog of employment based backlog of green cards. This bill infect reduces number of legal immigrant visas from 140000 to 90000 immediately for people who are waiting line legally and been paying taxes and contributing in fields of Computers , technology , pharmacy , nursing.
2. This bill makes things difficult/impossible of renewal of legal visas for me and my sister(both of us are on H1B).This bill changes renewal of H1B from three years to one year even if green card application is pending where as undocumented/illegal persons can renew their Z visa unlimited number of times even if they have no intention of applying for green card.
3. This bill puts more restrictions on H1B visa while awarding Z1 visa for undocumented /illegal persons with far less restrictions. Z1 visa can be self petitioned, they can work for any employer of their choice and job of their choice and they don’t even have to work as long as they go to school. H1B is far more restrictive, H1b visa holder is held hostage by employer and employer has to file the documentation for eligible candidate.
4. This bill does nothing to lift the per country allocation of green cards for legal/merit based applicants of green cards. If merit is the criteria for green card why should it matter what nation one comes from. Amazing thing about this bill is that if you are illegal and have a Z1 visa it does not matter what country you are from, NO COUNTRY BASED CAPS FOR UNDOCUMENTED/ILLEGALS (They are no more illegal because they have Z1 visa)while applying green card.
5. New merit based system that senate is planning to introduce is totally skewed towards illegal/undocumented people as well. Some of the key points, If you have a Z1 VISA(ILLEGAL/UNDOCUMENTED) and own a home you get some points in green card , If you are legally here and paying taxes and own a home you don’t get any points. If you have a Z1 VISA (ILLEGAL/UNDOCUMENTED) and have health insurance you get some points in green card, if you are legally waiting in line and have health insurance for whole family you don’t get any points. If you have Z1 visa (ILLEGAL/UNDOCUMENTED) and you have kids, Kids get Green card in 3 years. I cannot imagine how educated illiterate IV members are. You think voting on some site will get the bill passed? I agree with Fresheb2 that this is a waste of time. You guys are only promoting some new site. This site will capture your email addresses and send you marketing material. If you read about the site owners, they are commerical companies and they seek to make profit from this site. Do not be fooled that someone will send your bogus votes to congress and the bill will be passed. The site only aims at generating awareness among US citizens about congress and bill. They probably got some grant or decided to make money off this idea and started this website.

Another thought: the flyer we have now was a good start, and at the time when we started we didn't have other material in place.
But esp in places which have a real bulletin board where information will stay on for a while, I think we should give out a little more information on who we are, what the problems is and what we are asking for.
So at a place like ICC, maybe we should pin a copy of our brochure, and another sheet formatted like the brochure in which we give instructions on how to donate money.
The brochure format and content also looks professional, more credible than a flyer that resembles flyers for rentals, car sales etc etc.

Its okay, some folks do not see in-direct benefit to them, but once they see the value they will stop complaining. We shouldn't just stop due to opposition. I agree this doesn't provide direct benefit to all and it is expected that people will oppose. It is the nature of human being, I bet if you start a debate over EB-2 & Eb-3, lot of people from EB-3 will complain and who are from EB-2 will be all over to save their spot in queue, and those who have jumped from Eb-3 to Eb-2 will just be silent watchers. I don’t blame them either, this is the irony of being EB I/C, which builds so much frustration. But given the current situation, we have not been able to get anything accomplished in last year or so, and no big CIR in near future, we should start looking for ways to get small fixes, could be recapture, five year EAD-AP, discounting dependents, etc. There are so many avenues we could explore, don’t know which one may work, but if it works if benefits everybody in one way or other.

The general idea in a desi mind is "why should this other guy get his GC first".
Good idea, but will not work since people cannot think outside the box. Most people think that if I cannot get a GC why should the guy in the next cubicle (who has a US Master's) get it. They don't realize that by taking the US Masters out of the regular queue, they would probably get their GCs faster :)

Nice to know that you started the process. Did you send the job transfer letter to USCIS along with H1B transfer or you just did H1b transfer (with plan to send the letter later).
In a way it�s nice that USCIS is tracking all applications together (H1B transfer, I140, I485 for a candidate). It atleast gives the confidence that they are tracking all together and may not get any RFE�s to give them copy of I140 or such.
Please share any updates.

My attorney, then send the AC21 with new employer offer letter to uscis.

In such instances, DOL provides notice to the employer in the form of a Notice of Intent to Revoke an approved labor certification that contains a detailed statement of the grounds for the revocation and the time period allowed for the employer's rebuttal. The employer may submit evidence in rebuttal within 30 days of receipt of the notice. If rebuttal evidence is not filed by the employer, the Notice of Intent to Revoke becomes the final decision of the Secretary. If the employer files rebuttal evidence and DOL determines the certification should nonetheless be revoked, the employer may file an appeal under 20 CFR 656.26 within 30 days of the date of the adverse determination. If the labor certification is revoked, DOL will also send a copy of the notification to USCIS and the Department of State.
