Folks,
Let us focus on the rally and recapture of visa numbers. This more important to all than fighting out the LS issues and finding fault it is not our issue. If the LS guys gets rejects, they deserve it for not using their own Labor, and they a price for the same. Let us not beat them with a stick and focus on what can be done now.
Let us not build hatred against anyone, this can only undermine our efforts. You never know, heard FBI Checks are strict on LS folks, hope that is true, atleast genuine filers get it based on their PD, so be 2001 or 2002 as long as they are the original beneficiary.

You can skip skin test and just straight away get a Xray done.
Also if its not possible to come here before Aug 15th ,then it will be very useful if she carries her titre's of all the required immunisations from an uscis certified physician in India and shows it to the civil surgeon here. Talk to the civil surgeon in person here and check with him if he will be willing to accept lab results from India .

Believe it or not, I was about to open a thread like this. And here is the worst part, my AP has been approved 10 days ago, and so far neither the online status changed to approved nor i have received the approval copy. 2 ways I found out my AP was approved was through my local congressman and I took an infopass appointment. In the info pass appointment when I asked what is causing the delay in sending an approved AP, the officer says, if you did not get the approval notice in 45 days, call us back. This after waiting for more than 90days from the date of application. So, its not there until you have it in hand. Merely getting an approval these days is not enough, since they take anywhere upto 45 days to send the approval to you.

I called too. They told me that NSC needs 2 month to process it--presumably, getting the FP notice out to me.

There may be a slight decrease in number because of retrogression, but i believe the bros&sis in the citizenship queue will compensate for that.
Naturalization queue is much bigger than AOS queue now and it has political clout. I guess probably thats the reason why they are expediting the namecheck now. USCIS dont want to be dragged into voter suppression mess.:)

Why did you choose your screen name as 'Hopefull'? Are you hopeful about yourself? Or are you hopeful about others? Or may for everyone? Either way your message and tone of your post doesn't sound hopeful for anybody. Could you please consider changing your screen name to "HOPELESS"? Hi,
I am joining new job using AC21 provision coming monday. My new employer does not provide medical insurance for the first month. I am eligible for after I complete 1 month.
So my question is: till the time I get medical coverage from new employer (approx. 20 - 30 days), can I invoke COBRA? I heard that one can not invoke COBRA if he or she is employed (only meant for un-employement) is this true?
Also, should I call my current insurance company for COBRA now, or I can wait if I really need to visit a doctor? is there a grace period for this? Because there is a possiblity that I may never would have to visit a doctor for next 20-30 days, but who knows!
Appreciate your answers.
Remember that you need to pay the entire cost of insurance from your own pocket for COBRA for whatever time you use it. Typically that's around $500 per month per person (depending upon the coverage, place, etc.). The only benefit of COBRA is that you can keep seeing the same doctor.

According to my lawyer, I-485 is applied by the applicant directly & not by company or lawyer. So, if you have received the I-485 receipts to your own address, then you will received RFE to your home address.

Its very very important to discuss this with your future wife. If your marriage starts with telling a lie, IMO, its not a good sign. Whether its good or bad, just talk to her and discuss the best available option. If she is really understanding and supportive of the decision you both make, then you have already started your marriage life with flying colors...:)
And BTW, if you are considering reentry permit (to be out of US for more than allowed time on PR) NEVER APPLY REENTRY PERMIT WHILE YOU ARE OUTSIDE THE U.S. IT'S GONNA BE DENIED AND THE APPEAL WILL ALSO BE DENIED...And you will be stuck outside U.S. with a PR...

What is your defintion of a large project ? How much budget/people/schedule etc should we use for that definition.
I would say it depends from organization to organization. The way I have seen operating in the industry, one could consider a project large if it has a $1 million budget or more. However, organizations could also consider a program with mutiple small projects with a total budget value greater than $1 million as a large project, where the PM may handle mutiple small projects which will cumulatively have a budget greater than $1mill.
This is also one way to justify the need of a PM.
What is the budget of the project is one of the questions that a PM should ask during an interview, so that he/she will know the stability of the project and its longevity.

OK guys, here is what I think. Being in US on a visitor visa, and then applying for an I-485 does seem like a violation of visa terms, but the other way round seem to be fine. I mean she can apply for an I-485 first in India, and then apply for a visitor visa later while her I-485 application is pending. While applying for a visitor visa she just has to honestly tell the consulate officer that her I-485 is pending and there should be no problems.
If she applies for I-485, she has *beyond a shadow of doubt" expressed immigration intent. Her visitor visa request will immediately be rejected.
If this is not so, then it means that all those who have filed I-485 in their home countries through consular processing route are in effect barred from entering US till some decision is taken on their application. This sounds bizarre. Does not make sense. What do you say?

From that time onwards s/he cannot apply for any visa that requires intent for non-immigration, such as visitor's visa, student visa, etc. He/she can only apply for a dual-intent visa, such as H1/L1/H4, etc., after expressing immigration intent.

If you have good documentation of this... then there are some fees that employers are not allowed to pass on to employee (either in part or in whole).
These include things like H1B processing fees.
They might include labor certification fees (required for GC).
Now unless the 50% specifically identifies which fees, I would take it to mean 50% of all. If your were charged for 50% of something that it is illegal to charge for then Department of Labor may pursue both on your behalf and in the public interest. By pursue, I mean get your money back (or some of it) and fine or worse to employer.
So find out what documents you have and where your local dept of labor is, and go and pay the friendly staff a visit.
I know someone that was done out of a few thousand in unpaid overtime. They got his money back for him, even though he only went to them years after, but he had pay slips showing hours worked and money paid. They handled it all for him.
