Without knowing the situation of all the students, it is not fair to jump into conclusions. I am sure at least a few if not all the students, left India and come here with an intention to cheat. Some of them may not have known the true intent or authenticity of this university. From their standpoint it could just be they have gotten into a recognized univeristy in the US and this was going to be a gateway to a bright future. USCIS should only have themselves to blame before blaming the students for issuing I-20s, CPTs and OPTs. If the students came here on valid I-20s and are doing all the right things by going to class, why blame them. Again there could be students who are taking advantage of the system and doing the wrong things but there is blame everywhere.
All of us come here with dreams, dont we. Sometimes the dreams turn into nightmares and when it does we dont have to go out of our way to support the students in distress but the least we could do is stay away from adding to their woes. This is not a time to play smart Alec.

I will be sending the following note to my senator and have already posted it to WhiteHouse.gov. I urge all those screwed by the ongoing retrogression to do the same.
"I am writing to inform you of how the country based quotas imposed on Employment Based green cards are unfair and totally illogical. When I immigrated to the US, I believed that this country was a meritocracy where you were judged based on your abilities and qualities. These country based quotas reward people depending on where they or their ancestors were born. This causes people from India and China to wait over a decade to get a green card whereas someone from another country with similar or lesser abilities can obtain permanent residence in half that time.
Since these EB category based green cards are awarded for professional skills, imposing a country based quota just does not make any sense. I urge you to work with Congress and change this discriminatory policy and reinforce that America is truly a society that celebrates meritocracy."

I need some help with my daughter�s EAD and AP renewal (e-filing) applications.
Here are the details. She came to US on H4 (I am the primary applicant, on H1B). As she was going to age-out in July 2007, she was transferred to F1 in April 2007. Fortunately, she was able to file I-485 in June, 2007 and got her EAD and AP. In 2008 she went abroad and came back to US using AP.
For I-765 EAD renewal (e-filing) what should be her response to following questions?

Mine is a CSC to NSC xfer case. FP done in Jan'08 Received HLUD on 02/09 and SLUd on 02/10 for me and my family's 485s. Nothing after that.
HLUD was
Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: This case is now pending at the office to which it was transferred.
The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office.

It may be right. Knowing the Indian government well, they would be the first ones interested in keeping as many people as they could on H visa, so that they would have transferable income to India. India would have even less reasons in any immigration reform for US permanent residency, as that could make us settle here and say bye, bye to India government and their cash cow.

My point is it does not do a damn thing for us workers personally. That money will dissapear into a dark hole in the Indian Gov't coffers instead of a dark hole here, further as the rules stand, I have a slim chance of getting the money from here through social security payments when I turn 65 even if I am in India. Try that within the money in Indian gov't hands.
On the other hand, it makes the Indian gov't allign with corporate america, as they all have a vested interest in a Temp. worker program such as H1b absent green cards. Which will be a win win for all concerned except us.
So I repeat my question..................Why is this good again?

I was denied life insurance by Erie based on my non-immigrant status. However, my employer found an alternative insurance company that did not mind my non-immigrant status - but of course charged a premium for the "added risk accrued by foreign citizenship and increased possibility of travel abroad". Its of course a different story that I CANNOT travel abroad frequently precisely for the same reason - the increased risk of DHS denying entry due to foreign citizenship.
I got a quote and passed the physicals, and only two months later was told the underwriter doubled the premium because I did not have green card.
For mortgage, you have to shop around to find one that does not mind your non-immigrant status. I was able to get preapproved for a first time buyer loan with low rate. But I did not purchase the house. So I will not know if they would jack my rate up at closing because of my status as the insurance company did.

For those of you celebrating the defeat of Democrats because they sabotaged CIR due to the "path to citizenship" it's time to get real. Conservatives (both Dems and Repubs) are more than comfortable shutting the door to ALL immigrants. Don't fall into the trap of anti-immigrant legislators, don't let them turn this into a wedge issue.
Turning on the undocumented is not what we want to show to the outside, it is a losing proposition and will turn off the public.
As to what to do now, I'm puzzled. CIR is effectively dead in the US House, probably the Senate as well. The voters said loud and clear this week that they want the focus to be on JOBS not anything else like grandiose immigration legislation.
What to do now? Looks like another 2 years tacked on to the wait from my perspective :/

Hydboy, you make a good point. Does anyone know if this is how USCIS would do a Qtrly Spillover if they do it ? And do they have to make the EB2-I and EB2-C dates the same before they do a spill over like they do it for the yearly?
The quarterly spillover is still a myth untill we see it happen one time. I don't recall a big movement in any quarter in the last few years.....except the last quarter of the year when they have done the annual spillover.
That said....I would obviously love to see a quarterly spillover as I think it might make my date current a few months earlier.

funny that you said that...man we all go through the same things...my 3 year old is the same way...wait till yours get to be 3 year old...then they *own* that space and there is nothing you can do about it...:) i suggest you should start letting your kid sleep in a different room from now on before its too late like my case

Believe it or not I got so sick of sleeples nights (my 18 months old kid virtually rotates like a clock on bed all night long) that I had to buy a twin size sofa bed and place it next to our King Size bed. These days I am sleeping on that bed.

I am glad to see the light at the end of the tunnel. I saw a welcome e-mail from USCIS today in the morning. Took 6 years to get the GC with a total stay of 10 years.
