At least it relieves some tensions when we do the predictions. These are vents for those who have been in the queue long time waiting for the Golden card (GC). Well, some of them would be sore on the looonnnng process.
We know that the relief is short lived once the bulletin come out.
Same things have been circling on and off.
Why should'nt EB3 move? EB2 alone need not move. The more things move in the immigration front, the more we could expect that they are trying to support the program than bust it.

My original "Reciept notice" of 485 came from "California service Center" then few weeks i got another notice of action notice type = "Transfer Notice" that said your application has been transfered to "Nebraska service center".
For EAD renewal should i send copy of just Receipt Notice or both?
Also should i send the EAD renewal app to "Texas Service Center" as per instructions because i live in MA ?
As per section 7 of the instructions "with a copy of the receipt notice or other
evidence that your Form I-485, Application for
Permanent Residence or Adjust Status, is pending"
So you should send a receipt notice and that should be enough.
But for the heck of it, it does not matter if u send that transfer notice.

- While on a H1 or a L1 visa, one is expected to maintain a continous period of employment. If one is on a H1 visa and does not get paid, that individual automatically falls "out of status".
- It does not matter if the person has other seemingly valid visa stamps on his/her passport.
- The only highly-skilled dual intent visas that allow one to work, are the H1 and the L1, as far as I am aware of. Dependent visas do not allow one to work, such as H4 or L2. The only way one can work while being a dependent is if one has an EAD based on a pending AOS(I-485).
- If one is on a H1/L1 and wants to switch to say a dependent visa (H4 or L2), one has to submit a change of status form (I-539?). The person is assumed to be in "authorized status" until the change of status (or even an extension) occurs. If the COS or extension gets denied, the person is retroactively "out of status" from the original date of expiration on the previous visa.
- Accruing over 180 days will entail a bar of 3 years for re-entry after the person leaves the US.
- Accruing over 365 days will entail a bar of 10 years for re-entry after the person leaves the US.

- If the home consulate approves the said individual's visa renewal or new visa stamping, that individual can enter the US, however, there is lack of clarity on whether such a person will be finally able to "adjust status" to become a lawful permanent resident.

I support this idea most.
I agreee with the spirit of things - that multiple ways of expressing anguish, disgust, frustration is required.
While we have to keep generating funds and doing the lobbying, the frustration of the members must be "used".
Here is my suggestion (and this was mentioned by someone earlier also) - let's send the criss-crossed and blackened photocopies of our degrees, patents, publications etc. to the congress and other authorities as a symbol of how useless these are becoming as we wait for GCs. We can coordinate the event such that everyone's reaches at around the same time.
Again, all I am saying is that we can do multiple things to gain attention and make our point, and these can happen simultaneously with the other activities ongoing at the State chapter level.

This was a good find. The decision actually opens up more doors then it closes.
USCIS in the past; and specifically Nebraska service center would deny I-140's if you did not have one single source degree equal to U.S. bachelors degree (ie., combination of degrees was not allowed).
this decision basically says that 3+2 will not be considered equal to masters but will be considered to be equal to bachelors degree. However, since the labor didn't allow for bachelors and five years of experience then they consider him to not be qualified for the position.
Looks like 3+2 will still qualify for eb2 but through the bachelors and five year route.
If you look through many of the appeals decisions you will even find contradictory stuff with regards to combination of degrees to get to bachelors equivalency for eb2.
That's why when you are first starting the greencard journey it is safest to go eb3 route and then later give it a try for eb2.

If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?

I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Just wondering if this could be the reason why we're getting a raw deal. Could it be that 'highly skilled' is not enough but 'genius' and 'highly skilled' is what's required here? Just a thought.
