Do you have 10+3 (Diploma)+1 or 10+2+3(Diploma)+1. If the second case, is 10+2 a requirement for enrolling in to the diploma ?
a 3 year diploma after 10th standard is not a bachelor degree. The US bachelor degree has 16 years of education.
How is the equivalency justified in the evaluation ?

I have been on H4 since 2000. I once got an H1-B in the year 01, but did not get to work. Meanwhile my H4 got extended till now.
With the recent changes of de-coupling H1 & H4.......
My question is can I use the previous H1-B issued in 01 and apply for COS without any cap restrictions ? And can this be used by a new Employer ?
Appreciate any responses on this. Thanks

bcos I was there stuck at BEC with no result in sight for 4 years.
My advice would be to file for another LC through PERM ( I know its hassle) & file it in the EB2 category if you are eligible (even if your company might not sponsor the 2nd labor, you should probably foot the bill). This way, you can retain your old priority date & file in EB2 sooner. Or maybe wait & watch how the cutoff dates progress ( I think EB3 will surely move to 2003 soon (early/spring 2008) for India.
I know that its not easy looking at all the threads talking about starting company using EAD, buying homes, recpt. number, AC21 etc. when you missed the boat to file I-485. But hang in there. When one door closes, another one opens.

Can you explain why EB2 ROW is flowing to EB3 and not to EB2 India?
It's just a decision that state department makes. I'm not saying it's justified. I'm not saying that's how it should be.
I think the logic is that when India EB2 became Unavailable and EB2-RoW was Current (for example in Sept Bulletin: http://travel.state.gov/visa/frvi/bulletin/bulletin_3009.html
If EB2 RoW were flowing into EB3 RoW, this would not have been possible.
I think it's an attempt to bring EB3 on par with EB2 (this is just my guess).

close to $500 excluding lawyers fees( i dont know how much company paid) .But the sad thing is I made my aged parents and in-laws run for affidavits /scanning etc in heavy rains .

I suggest you wait and see if you can reconcile your differences......Marriage is a life long commitment. Remember we fall in love and we work on our marriages. Try reading the book called "5 Love Languages" by Gary Chapman....It is an excellent book for couples who are on the verge of breaking or even for couples who want to enhance their married life.

My I-140 is approved in 2006 and now i have filed my I-485. My employer has not given me any kind of doucments like I-140 approved document or Labour Substitution document. The only form he gave is ETA 9035E after my substitue labour was approved. If I want to change job after 180 days using AC21 do I need any of doucments from this employer. If my employer is not ready to give , what is other alternative. Plesae advice.

I don't think consulting firms are alone to be blamed.
Lets say there are around 1000 consulting firms it the worst case there may be around 1500 firms which have a capacity to apply 15 H1B each.
still the number would come around 15000 to 30000 but the big 4 companies in India got 20,000 H1B last year, which means they might have applied around 45000 to 55,000 applications
my numbers may be bit off but i think Big 4 companies from India are doing more damage then consulting firms in US.
Guys.. i'm sick of this nonsense.. I mean this is ridiculous.. this is my second go around in this stupid lottery.. last year I hadn't graduated so they put me in the bachelors quota.. this year the freaking masters quota is full.. i have a genuine offer from one of the big 4 accounting firms.. and have work experience to back it up
i'm sick of these consultant firms.. i wish I could work for the uscis and weed out these miserable cheapsters.. 6 years toiling in their education system, paying the damn taxes, and waiting for 1 smart person to come along and tell them its time to take care of these consultant companies and their consultants who get the jobs based on deceit and conmanship..

A freind of mine came across a gentleman, who is here on work visa and he is facing a unique problem. He is married to two persons and wants to bring his whole family here in the USA. He was looking for answer if he can get both his spouses and kids here on H4 visas. Currently both of them and his kids are in India. Interesting hmmm :D
